Public Guardian Suspended

Attorney Ronald K. Nevin served as the public guardian in Davidson County. As public guardian, he managed the financial and personal affairs of people under conservatorships or guardianships.

A Petition for Discipline against Ronald K. Nevin was filed, Nevin appealed, and the disciplinary order was upheld by the Supreme Court.

Mr. Nevin improperly transferred money from his trust account to a conservatorship account, failed to preserve the identity of the ward’s money, improperly retained interest owed to the ward’s account, and commingled trust fund accounts. Further, in a second matter, he failed to act with reasonable diligence and promptness by failing to file an accurate inventory of the ward’s assets and by misrepresenting the value of the client’s estate to the probate court. In the third matter, Mr. Nevin failed to act with reasonable diligence and promptness by failing to safeguard a minor’s assets resulting in a tax sale of the minor’s property.

A Hearing Panel recommended that Mr. Nevin be suspended for six (6) months. Mr. Nevin appealed the Hearing Panel’s recommendation. The Chancery Court affirmed the Hearing Panel’s decision. Mr. Nevin appealed to the Supreme Court. The Supreme Court affirmed the Chancery Court’s judgment.

Only a six-month suspension?
If this was a family member of a ward, I am certain that criminal charges would be filed and the alleged would be in jail.

No wonder the statistics on elder abuse are inaccurately reporting.

Lawyer guardians get off easy. Family members are nailed.

A suspension? Not good enough!
When a perp plays with money which isn't his, he can no longer function as a fiduciary!

I am steaming. Suspension? and then what?

He is back in the position as public guardian?

Who is responsible for hearing this case? Other lawyers in the good old boys/gals club?

Ronald Nevin is a miserable failure and he deserves a harsh punishment for his criminal behavior.

This weak, ineffective consequence for failure to perfom duties while in a position of TRUST of a slap on the wrist getting only a suspension would be a joke and laughable if it weren't so serious and so widespread.

I nominate this case for a skit on:

Pitiful. It's probably a six month suspension - with pay, I bet!

The public guardian works for the public. Anyone in a position of holding the public trust and who abuses that trust, deserves even stronger punishment than the average thief.

There isn't a book heavy enough to throw at this guy.
