The Nebraska Supreme Court suspended an Omaha attorney's law license for two years Friday, citing improper conduct connected to her handling of court filings in a family legal dispute.Julianne Dunn Herzog failed to tell a Douglas County judge about court papers she had filed in a dispute over guardianship of her elderly mother and had filed the papers to "harass and embarrass" a brother who served as their mother's appointed guardian, the court said in its ruling.
The court's Counsel for Discipline had charged Herzog with four alleged violations of the Nebraska Rules of Professional Conduct. After a hearing, a referee determined Herzog had violated three sections of the rules and recommended she be disbarred.
In its ruling, the court noted Herzog's misconduct had only happened "in the context of emotionally charged and highly personal matters," and said she was not likely to behave in such a way with other clients. They also pointed to Herzog's claim that she was facing emotional, health and financial problems.
"Herzog's repeated and obsessive acts of misconduct" in her mother's guardianship and conservatorship proceedings "do not warrant leniency," the court wrote. "But, in our opinion, they are not so egregious as to warrant disbarment."
In its ruling, the court said Herzog has disagreed with her siblings about virtually everything related to the guardianship case and had faced disciplinary action in the case twice before. A lower court judge appointed Herzog's brother as their mother's guardian, and concluded it was in her best interests to live at an assisted living facility in Minneapolis. The brother was authorized to control visitation and telephone calls, and to have sole contact with their mother's living facilities.
The court said Herzog filed various motions in the guardianship case, claiming to represent her mother's interests, when she actually had been granted leave to withdraw. She received a private reprimand from the Council for Discipline.
Her second disciplinary action in 2008 resulted from evidence showing she filed two notices of appeal and a petition for further review on her mother's behalf. The Nebraska Supreme Court issued a three-month suspension for her "continued unethical behavior," followed by one year probation.
The third action, which prompted Friday's suspension, originated with a July 2008 court hearing on Herzog's filings to remove her brother as their mother's guardian. Herzog had referenced bruising on her mother's arm as evidence of possible abuse, and said she had been unable to learn other details about her mother's health.
A judge later learned Herzog had filed the same court documents in Minnesota, where her mother lives, three days before the hearing without telling him. When the judge questioned her, according to the ruling, Herzog raised her voice and accused the judge of abuse. Herzog said she did not know that the documents had been filed at the time of the July hearing, the ruling said.
Herzog, in an interview, said she was "sickened" by the court system, which she said has failed to protect her mother's money and health. She said she was acting in a personal, private capacity and was represented by a Minneapolis lawyer who had advised her to file the court papers in Minnesota.
Herzog said her 88-year-old mother is in a Minnesota facility, and that her brother terminated her visitation rights 20 months ago. She said her mother has broken her wrist twice at the facility, has lost weight and suffered other injuries.

Family disputes should never go to court.
The lawyer obviously had problems complying with rules, but what drove her to that?

Robert Case, a county attorney for Human Services in Colorado stated, "In probate cases the court relaxes the rules." In fact, this relaxation only applies to him, the Human Services and the fiduciaries the probate courts appoint. Family members, even family members who are lawyers who have tried to present evidence of abuse, false reports or other forms of foul play by Human Services, lawyers like Robert Case, guardians, conservators and trustees find themselves viscously attacked by lawyers such as Robert Case, based on all manner of claims the family member violated rules so small as the size of the margins on their pleadings. These stick and allegations against Robert Case, Human Services, and professional fiduciaries working with Human Services and the courts are ignored. The result is lawyer are afraid to represent senior citizens and disabled, family members are banned from proceedings and seeing their loved ones, and Human Services gets to put this data into data banks to make the problem of senior and disabled isolation worse.
At the beginning of reading this article, my first thought was,gee,I should file a report against the administrative judge over my mother's case; who appointed my brother an ex-practicing attorney in a psychiatric dissability -guardian of my mother's property. The judge over my mother's case was aware of this fact,I told her in court, and indeed even my brother when asked had stated it under oath and was on the record as documented on a court report!!! -- as I continued reading this article it was obvious that this Omaha Lawyer is indeed another victim of the same system that pretents to be protecting her mother- just as I have had been- and who is been punished by suspention for trying to use her skills and know how, even under advise of nother attorney, to save her mother from the pain and suffering placed upon her due to the guardianship proceedure.I could feel the frustration on all of her actions and the defeat of someone that knows the painful power of injustice -- I certainly hope that someone will investigate this case and take the proper action against the judge involved. As I had said before, if there is a family dispute, the case should be in family court; if an allegation has been made, it should be investigated and if found true- then the case should go to criminal court.

I bet Brother was never worried about Mom until there was money to steal. Wouldn't an attorney daughter be the best guardian? Why was brother appointed?

Where is the documented proof Julianne Dunn Herzog filed papers to "Harass and Embarrass" a brother, the appointed guardian who apparently isolated their Mother for over 20 months from her.
Go into search on the internet, look up "Elder Abuse," Bruises on the elders tops the list along with Isolation of the elder.
It would be interesting to read the petitions Ms. Herzog filed against the guardian to find out what prompted her to file motions on behalf of her Mother, apparently there was/is suspected abuse of her Mother by the guardian.
If this is the case "Why wouldn't Ms. Herzog file motions with court reporting ABUSE of her Mother by the guardian ?

What If a Guardian Does Not Appear to Be Doing a Good Job?
ANYONE may question whether or not a person is carrying out his or her duties as guardian, either by contacting the judge, the probate court investigator or the clerk of the court. However, it may be necessary to bring the matter to the judge’s attention formally with a MOTION to reveiw the guardianship.
Looks like Ms. Herzog is following court protocol.

Just because someone prints this stuff and we only get to hear one side,... does that make it True ? HARDLY !
How can a referee, one person,
make such accusations without giving the readers BOTH sides of the story which Ms. Herzog's side
has been conveniently left out.
The court, meaning the judge noted Ms. Herzog's misconduct was emotional charged with highly personal matters. WHY WOULDN'T SHE BE EMOTIONAL THIS IS ABOUT HER "MOTHER," who gave birth to her, raised her, taught her right from wrong, protected her.
Of course she's emotional and has health and financial issues, she's fighting for the Rights of her Mother...Ask anyone in a guardianship battle, it devours your life, health and your finances.
There is no way Ms. Herzog could separate her emotions
from this case, it's about her own Mother. Ms. Herzog's other clients are completely separate cases and issues and have no bearing on this case.

Mother's Constitutional Rights is NOT misconduct, it's a Couragous Act on Ms. Herzog's part as an American Citizen.
To put it in proper context for the court and the referee to understand, if someone was getting ready to push you off a cliff, without reason or cause, just because they wanted to and has powere to do so... wouldn't you want your family to Fight for your Right to live your life ?
Ms. Herzog's acts of repeated and obsessive acts are NOT acts of
misconduct, nor are they acts that
deserve disbarment ...Ms. Herzog's acts without a doubt deserves Leniency,
Ms. Herzog is pursuing an action on behalf of her Mother which she obviously believes the guardian has harmed her Mother.
It's the law and our duty to report abuse of an elder or citizens of any age. We've always been taught to call the Police for help when in harms way, however, in many gaurdianship cases, the victims are gagged, locked up while the perpatrators are set free to continue to abuse the victims !
It takes real courage to fight a system that hides the truth.

This is an outrageous act of misconduct by the judge, not the attorney.
When judges act illegally and immorally, the last resort is appealing to "the king" - in today's parlance, the legislature. Legislatures need to start impeaching judges for outrageous conduct like this.
I need legal help, and am in the same state as this attorney. I would really like to contact her to see if there is any strategy that can be used against these (insert any French you find applicable). Also if some jurisdictions are better than others. I realize she is no longer practicing, I mean just as a person fighting the system. I am a member of NASGA, and would like Ms. Herzog to contact me if possible. We are in the same state,I have found other people willing to be my loved one's guardian, but need some strategy as how to go about this.
