Sara Harvey has been battling over five (5) years for her disabled husband's (Gary Harvey) rights with Chemung County, who has guardianship of her husband, and has taken her plight to the Federal court in Rochester NY. Mrs. Harvey’s allegations submitted to the federal courts are:
• The county agencies have allowed St. Joseph’s hospital in Elmira NY to bill her private health insurance approximately $1 million a year for her husband’s medical care. Mrs. Harvey is being denied access to her private insurance as to what those services are allegedly being provided to her husband.
• Mr. Harvey is being denied benefits from his private health insurance, and is being discriminatorily institutionalized for over 5 years by the county guardian, leaving her husband in the most restrictive environment, against what would be Mr. Harvey's wishes.
• Mr. Harvey is being unjustly denied visits from family and friends and is kept in isolation behind closed doors for over 5 years. Mrs. Harvey can only visit her husband six hours a week and is unjustly supervised by an agency hired by the county that was paid by her husband - and now being paid by tax dollars. The guardian has installed a security camera in Gary Harvey's hospital room which raises the question to whom is paying for the unwarranted intrusion.
• Medical decisions about her husband are made by lawyers and other non medical professionals.
• The county, hospital and Mr. Harvey are being represented by same law firm which places her husband at a disadvantage for being a "cash cow" for the county’s private clients. What is scandalous, immoral and unethical is one of the county attorneys sat on the board of St. Joseph hospital. The assigned case worker is employed by the county agency (“Adult Protective Services”), and the hospital where her husband is a patient has authorized over 35 procedures that are not routine. Mrs. Harvey believes they have never obtained an order of access to her husband.

There is no doubt, that Gary and Sarah Harvey have been deprived of their civil rights, since he fell ill. However, when he was discharged from the hospital for the purpose of rehabilitation, was Sarah Harvey able to give professional care to her comatose husband?? Was she, or her home approved to give professinal care???
I think the medical authorities consider a patients prognosis first and foremost, before allowing "home care".
Let me get this right - Sara Harvey pays for her insurance and it's used for her husband, but she is denied information about what's being billed to her insurance company that she's paying for?
It makes no sense!
Anonymous, Sara Harvey is willing and able to take care of her husband at home. She has all the necessary equipment in place and has taken extensive training in the care of a severly physically disabled person.
Also, Gary Harvey is not comatose. He's been diagnosed as PVS, to my understanding.
until Gary Harvey gets the qualified medical assessment and independent second medical opinion to which he is entitled, there is no telling what his true and accurate medical condition is.
Anyone on a steady diet of morphine, valuim and phentynal would present as being comatose, never mind the county doctor treating Gary testified that he has no idea if Gary is in pain that he necessarily needs this cocktail of narcotics
These charges make me sick. You should be ashamed, Chemung County!
Gary is overmedicted all this to keep him flat on his back keep him drugged up to keep him from speaking out.
Those who are doing this to him a Veteran who served our country, I hope you all burn in HELL for eternity and that still wouldn't be nearly enough punishment for the cruel inhumane treatment.

honeybear, there is no shame in the world of unethical cryonism for profit. These profiteering frautsers clamoured all over themselve to get Gary as "a client they like" because Gary could not and cannot speak and defend himself. With Gary being of no concern because he cannot speak, all these punk arse bullies had to do then was bash, slander and retaliate against Gary's wife to keep her off-base and in turmoil and while she is/was busy defending herself excluding Gary became very easy.
Then came NASGA, and now history is being made.
The "incest" of the players all related to the same law firm is astounding. Looks like they've been dealing from a stacked deck.
A Case to Watch. And America IS watching. If Sara Harvey is successful, this case will bring down the Guardianship Cartel in her area. It will be interesting to see if (and how) the Feds relegate their responsibility back to the offending State Court...And if Sara will be afforded HER RIGHT to a Jury Trial.
Tip of the ice berg..There's more than this than what has been filed. I have wanted this case to go Federal last year.
