Yvonne Sarhan, never wanted nor requested a guardian, this was forced against her will. Yvonne Sarhan requested orally and in writing to the judge, that if she had to have a guardian she wanted her son, Robert Sarhan. Yvonne Sarhan was competent at the time of her being adjudicated incapacitated on August 5, 2003. She was ruled competent by the Court appointed psychiatrist on March 10, 2004. Another doctor, also a board certified neurologist, evaluated Yvonne Sarhan and both agreed that she was competent and had good judgment and insight about her financial and personal life.

Dr. Sarhan's plea is but one of many. A forced guardianship against the will of an "alleged incapacitated person" is an epidemic practice throughout the United States. Many times these proceedings are unnecessary and then become abusive.
Sadly, complaints such as this one seem to be surfacing more and more.

ReplyDeleteAs a mother of two adult children and also a grandmother of two minor children - your plight to be your mother's guardian angel would make any mother across the entire World Globe - very proud to have you as a Son. When, I initially read your legal plight with the Miami Dade County Courthouse System - I must admit that I felt your pain and frustration. It is yet beyond my comprehension, why any court would disallow a man of your profession, Dr. Sarhan - the legal, moral and ethical right to have guardianship over a parent. It appears that a fact of this case is that your Mother could have expired, if she was too expire at all, February 2010 - in her familiar surroundings, at home. Certainly, there was enough money in her assets to allow her the dignity of hospice in the privacy and convenient living of her own luxurious home. To defray the enormous cost of attorney fees-you or another family member should have been allowed to be the legal guardian of Mrs. Sarhan assets and her, in my opinion. In which, she could have lived out her life expectancy - in the comfort of her own home, in familar surroundings.
It appears from reading what happened to your mother - under the alleged cloth of the law that something went terribly wrong.The fundamental legal question or question of life - at this time, in my mind eye is this: Can the courts return to you, your son and the Sarhan family - Mrs. Sarhan? I ask is only for people in whom read this tragic story is to really think about what has happened to your mother and that is she has expired and you tried to warn people of power to return your Mom and that you believe that the medicine that your Mother was being administered would eventually kill your Mother and your Mother is dead. So, the answer to the question is an astounding - No the courts that took your Mother from your care and placed her in guardianship under a set of alleged court circumstances deriving from alleged court orders - can not make you or your family whole-your Mom is dead! The second question that derives in my mind, upon reading the love story of your Mom from a devoted Son name Dr. Robert Sarhan is this: What is the price/cost of loving a Mother in which a Son must pay to allegedly Judge Celeste Hardee Muir and/or the other alleged Judges and/or lawyers that have been indirectly or directly involved in the guardianship matter of your Mom and now her alleged premature death-due to what you tried to warn was a medication being administered. I believe that the net results of those in whom you tried to warn not to administered the medication to your Mom because it would kill should have some type of legal alleged ownership for the net results of what you believe as a Doctor caused your Mother the ultimately price of her life. Will it bring back your Mother-No. But, a legal record will help others in whom may follow the path of Hurricane Miami Dade County Court arena to have a better ending. I am so sorry that you and your family had to endure this hardship and to her grandson, I can only imagine the void that has been left in his life of not being able to see his grandmother or to feel the warmth of her kiss upon his face and a pinch possibly of his cheeks from grandma. To say good luck and much success is an understatement. But, I will close with this-I expect something good to derive from your pain and your family pain and loss. Perhaps, upon your winning a land slide lawsuit, other families will not have to go through what you and others have experienced. For instance, I would like to see a television show like the John Walsh Show in regard to Adam Walsh. But, in the name of possibly your Mother, Yvonne Sarhan - that will perhaps consistently uncover the alleged exploitation of the Elderly and their family(s), all across America, as well as other countries.
