Ten Years of Financial Abuse

Leroy Newton, Erna's only child, is an investment banker in California. Erna trusted his knowledge and advice. The next thing she knew, her house, her stocks and all her worldly goods were the property of her son. Far before her death.

She appealed his creation of a trust that kept her from accessing her own money, and she won.

She changed her house back into her name, and waited for her other assets to be returned.

Sadly, there was a lack of follow through by the Clackamas County Oregon lower court, "administrative neglect" it's called. The court documents from Erna's "win" were never filed, and therefore left her son a window to finalize his takeover.

When Erna learned of this mishap, she appealed to the court to uphold the decision in her favor, and she was denied. Next, a trustee was assigned to Erna's inheritance without her ever being declared "Incompetent".

Eight years later, now recovering from a stroke, Erna has spent herself into debt defending her right to her own property. Her son has fought her all the way.

Finally, in November of 2007, the Oregon State of Appeals court agreed to allow the documents to be submitted, and the case revisited.

Erna filed the paperwork in January 2008 and her son's attorney drug his feet in responding, receiving two extensions after defaulting, and even missing the extension deadline by three days. His paperwork was accepted, nonetheless.

Erna's a survivor, and she's vowed not to let her son get the best of her. She intends to see justice served.

    When a judge, who swears to uphold the law, knowingly violates it instead, do you think it's done for free?

    Why are judges lawyers? Because they're supposed to know and apply the law!

    These perps - judges and clerks - should be removed!

  2. Judicial administration overlooks exactly what is profitable for them. That is what happens in our case and most probate cases.

    We have been pointing out their omissions and failure to perform for over 6 years now and continuing. The statute of limitations runs out and their cronies are free.

  3. I think the judge is in on this, part of the good old boys club.

    The son is a real SOB. I would like to see him charged and prosecuted for financial exploitation of an elderly person and rot in prison along with his low-life crook of a lawyer.

    The crooks thought that they would go for PLAN a: drag this out long enough for the complainant, Erna to become impoverished, or completely incapacitated or pass away.

    I think if Erna still has any energy after getting her life and assets back, she should sue the county for their neglect.

  5. Think on it --- 10 years out of this woman's precious life is spent trying to get her assets back from her very own son whom she spent many years raising.

  6. What is wrong with our Justice Sysem that an elderly person has to spend Ten years and life's savings fighting for her rights and property?

    I hope Erna sues the pants and shirts off all involved including the county.

    Her son's actions are illegal, how he got away with this scheme is curious and suspicious.

    Where is the FBI?

  8. I agree, Anonymous 2, the delay is designed to wear Erna out emotionally, financially, and physically. And if she died, they'd be all the happier about it.

    This is a sad, sad story.

    However, it's also a hopeful story. Erna sets a fine example of a person wronged who instead of folding, just gets stronger!

    And heads should roll for what they did to this innocent woman!

    Have they done anything to assist Erna and others in her hell hole of litigation? Anyway to find out about AARP?

    I hope he (and his lawyer and the court system) gets 10 fold of misery and grief for what Leroy Newton caused his own mother at the end cycle of her life.

    What is going on in that courthouse?

    Is anybody investigating judicial wrongdoing here in 10 years? This judge needs to be removed a.s.a.p.

  13. I have tried it all, from Law Enforcement to Adult Protective Services, to AARP, ACLU, Attorneys who took a retainer and did nothing, but drop it back into my lap. A judge in Circuit Court who would not recuse (remove himself from the case), to a Probate Court Judge who signed an order to appoint a Successor Trustee to blan copy of "a Trust" document by attorney affidavit only, removing my legal rights to my Inheritance during my lifetime. AND - such "blank" copy of trust is not found anywhere in the court records. It reduced my limited income, and the "Trustee" is allowed to take his fees of the top, before sending my "allowanmce" to me. It violates State and federal contract, and trust laws, and violates the U.S. Constitution to deprive me of my rights. BUT- who is to sue whom? The Judiciary stanjds by itself, and once in the system, there is no end to the tyranny, no matter how obvious their errors. They never admit to it. I may have created a nuisance to the Oregon judoiciary, but I have no other choice but to fight for my legal rights to my ownjproperty.
    Thanks to all of you for your support. We need to
    change the laws at all levels to mandate the protection of the most vulnerable in our society.

  15. This is a perfect example of at least three people who have an inordinate sense of entitlement, and a complete lack of morality. It is my opinion that they have been completely demoralized by the culture within which they work.
    Legislators created laws that scammed the American people as far back as before 1913. They have CONTINUED and COMPOUNDED the scams (private laws) EVERY YEAR or TWO since then, by ratifying them.
    The result is this trio (a disgraceful, scamming, unempathetic son, a dishonorable lawyer, and what appears to me to be a colluding judge. Since unlawful Acts were passed declaring the people of this country as enemies of the U.S. corp., the people should declare officials of the U.S. corp. (D.C.) their enemy, at least until those officials in office DECLARE a remedy for the scam (fraud) that was perpetrated on the people of this country.
    The disgrace is that the system is overrun with spineless, gutless, greedy characters without an ounce of honor.
    What a disgrace to my country, to my founding fathers, to the framers, that the legal profession, the judiciary has become.
    I can only hope that the ingrate son will experience the most extreme of betrayals before too long.

  16. The Oregon Justice Dept.-Education, with assistance of the Oregon Court of Appels, and the Oregon Supreme Court, published a "Benchguide" title "The Elder Persons and Persons with Disabilities Abuse Prevention Act, ORS 124.005-
    124.040, which under various statutes, discusses the "wrongful taking, improper motive, and abuse of vulnerable persons" but I am surem it is gathering dust in most judiciaries, otherwise it would not be possible, that the same contributors to this phamplet, are the cause of tyranny by the same judicial system, giving the perpetrator of abuse and exploitation,all of my assets, even though all my assets are recorded in my name. Probate Fraud
    did not change that, because the trust enforced, is nowhere to be found in court records. Makes one wonder, who is actually at the helm.It has been insinuated over and over again, that I am a "crazy old woman, with an obvious confused state of mind," when I attempted to expose Fraud by these members of the Oregon Bar Association, even the courts, who have legislated from the bench, and ignored the laws we do have in place. Law Enforcement considers most elder abuse violations as civil matters,rather than criminal. leaving most seniors to fend for themselves,because the do not have the money to retain legal help. So it is easy for a perpetrator to get away with exploitation and fraud on the elderly.
