'The Whores of Justice'

IT HAS BEEN SAID, THOSE WHO DO NOT LEARN THEIR HISTORY, WILL RELIVE IT.

What has happened in the Sykes case and some of the elder abuse cases is indicative of what can happen to you, me etc. Guess who the ARDC is investigating! It is not the two guardian ad litem, it is not the attorney who breached his fiduciary relationship to his client, and it is not the attorney whose statements to the court are fictional. It certainly is not the judge who directed the candidate for plenary guardian of Mary Sykes to find a doctor who would be loose with the truth, or who revealed that an order that is final in just about all courts can be overturned with clout! H(#* no! The judge was elevated to the Appellate Bench! The dishonorable lawyer brags in Court that he is being advised in his perfidy by the Attorney Registration and Discipline Commission! Indeed, the criminal are all such august persons as to have immunity.

It is going to be very interesting to see if the United States Department of the Treasury (IRS) can be bought! Mary Sykes estate is just West of a million dollars at this point in time. Theft by a fiduciary is a taxable event - that means that the plenary guardian and her co-conspirators owe Mr. Obama about $300,000 in unpaid taxes. Add the fraud penalty that you or I would be charged that makes it $450,000.00.

Add the other plenary guardians who have stolen millions aided by the Court - if they paid the taxes due to the United States of America we could start putting a dent in budget problem.

  2. Just one thing -- they (the fiduciaries and courts) have learned from history. They just get better and better.

Thank you, Mr. Ditkowsky, for your eloquent statement.

  3. Find out just what the people will submit to and you have found out the exact amount of injustice and wrong which will be imposed upon them; and these will continue until they are resisted with either words or blows, or with both. The limits of tyrants are prescribed by the endurance of those whom they oppress.
    — Frederick Douglass, civil rights activist, Aug. 4, 1857

Any power that can be abused will be abused.
    — Tyranny Law #1

Abuse always expands to fill the limits of resistance to it.
    — Tyranny Law #2

If people don't resist the abuses of others, they will have no one to resist the abuses of themselves, and tyranny will prevail.

  6. COMMENT FROM PROBATE SHARKS:

    GD LA said...

Dear Mr. Ditkowsky, I live in Louisiana where the vehicle for the removal of Constitutional rights is interdiction.

Interdiction in Louisiana is for the protection of "Idiots." This term was changed in the 80s age of political correctness to "incompetent."

My rights were taken from me via an interdiction petitioned by my former spouse after the divorce during the property settlement. The list of judicial and Constitutional violations is too vast to go into so here it is sufficient to note that numerous violations took place in order to get and keep me interdicted until the curatrix (female guardian and personal friend of the judge and petitioning attorney) finished stealing my assets AND filing fraudulent tax returns in my name.

This brings me to my point. The curatrix never paid the tax debt she created in my name and will not be held liable. I am not interdicted anymore and since the curatrix DID NOT pay the tax debt she created in my name; I am now liable to pay the over $100,000 tax bill.

The IRS told me that since the curatrix had the authority of the court to file the returns in my name then the IRS has to honor the judge's decision to appoint the curatrix and assume the returns filed by the curatrix are correct and that she filed these in my "best interest."

It matters not that the primary justification of the curatrix to liquidate my estate was to pay the tax bill. She, of course, did not pay the tax bill; she paid herself and the gaggle of attorneys she hired to "act in my best interest."

Now my life savings are gone and all I have left is the insurmountable tax and other debt she left to me.

Although the curatrix was and still is legally responsible for her actions; she will not be held liable because she had the authority of the court to take my money and do whatever she wanted with it.

Manipulating the law and truth is the stock and trade of enterprising officers of the court; add in judiciary discretion and voila the Constitution is history. "When we hang the capitalists they will sell us the rope we use." ~J. Stalin.

The legislators should be throwing out any law that allows for removing a person's constitutional rights. But instead the legislators are making laws that will make it easier to take our rights.

"It is true that liberty is precious; so precious that it must be carefully rationed." ~V. Lenin. Elders, the disabled, and children are the first as they are the easiest targets because the Government can muster sympathy to justify the Government's position to "Protect" these. "A lie told often enough becomes the truth." ~V. Lenin.

Mr. Ditkowsky, your statement, “…can happen to you, me etc.” is an understatement.

I was 56 in 2008 when they started the machine to take my rights.

I worked all my life as a physical scientist in first the oil industry and then for the D.O.D. I am on disability for anxiety which is a far cry from incompetency.

And to justify the removal of a person’s rights to file tax returns for them is really scary.
Please add Louisiana to the list of "criminal enterprises."

  7. Very well said, Ken D. Unfortunately, this is not an isolated Crook County Illinois case... the Cook County court players have mastered the art of getting the family out of the picture so they can have access to the estate.

Once they have access to the estate, they sell the house very quickly; it is then often sold quickly for a profit. Sometimes other wards' estates are utilized to launder the quick sales of other wards' homes.

Once the estate is liquidated, the guardians place the estate into an OBRA trust. OBRA trusts allow the ward to qualify for public aid housing, and, as such, the wards are prohibited from living in private pay housing.

However, the OBRA may be used for attorneys' fees and guardians' fees. How convenient is that!

The attys, guardians, and public aid nursing home owners get rich. The attys and guardians eat up the estate, and the nursing home owners keep their beds filled with wards of the court, with us, the taxpayers, footing the bill.

And the wards' quality of life goes down the drain.

This needs to stop. The patterns ring of racketeering.

    Please investigate.

The Whores of Justice, A Response

Thank you for sending me a copy of the letter. My response is as follows:

Every morning when we get up in the morning we have to look at ourselves in the mirror and ask the question do I like the person that I have become. Part of liking the person I am is to stand up for your rights.

A conservator or other person who assumes the duties of a guardian is a fiduciary. A fiduciary owes the highest degree of loyality to his/her ward as a matter of law. It may not be politically correct to complain concerning Court appointed fiduciaries, and it may be expensive - BUT it must be done if they in fact committed some wrongdoing.

The fiduciary who steals or misapplies a dime creates a taxable event. Thus, if your assets were indeed misused you have a bunch of remedies:

    1) the fiduciary to assume his/her appointment must put up a bond. This bond reimburses the Estate (you) for any misdeeds.

    2) a fiduciary who is negligent or intentionally miscreant also has liability and any personal profit is presumed to be wrongful. Thus, a fiduciary can be sued in State Court for his/her negligence or wrongful act. A constructive trust then can be imposed upon the assets for the benefit of the Estate (you). Most states charge the attorney fees to the wrongdoing fiduciary. (Check with your State Bar association - they are very nice people and may be able to direct you to an attorney who would be willing to address the wrong that you have suffered).

    3) If all else fails Mr. Obama needs the tax money - and each dime misused and/or mis-spent is ordinary income to the miscreant fiduciary. ergo, the errant fiduciary should be paying substantial income taxes (and penalties and interest) on the funds he/she misapplied.

It has been said that the reason that the ten commandments were removed from the Court house is that their presence created a hostile work environment for the lawyers and judges.

The ten commandments were not removed for that reason and Civil Rights is not a 'game' it is serious business. We have laws in the United States and if we do not exercise them and do not take advantage of them we lose them.

The Justice Department has a Civil Rights Division - become pen-pals with them. The Congress has committees on aging - become pen-pals with them. Do not accept an injustice as a 'given!' There are attorneys out there who believe that parens patrie is not a code word for screw the lame, the sick, the elderly etc. The league of Women Voters published a statement "democracy is not a spectator sport."

Gloria Sykes is fighting back! She filed complaints against the attorneys with the Illinois Supreme Court's Attorney Registration and Discipline Commission. She filed complaints with the Illinois Judicial Inquiry Board.

She has written to her Federal Representatives and Senators. Yes, so far the response has been silence and inaction. I guess that is not entirely accurate - the Attorney Registration and Discipline Commission is investigating me!

I had the temerity to do a bit of investigation of the Sykes case. HOWEVER IF ENOUGH VICTIMS OF THIS TERRIBLE SCANDAL WRITE AND FILE COMPLAINTS THE VICTIMS WILL BE HEARD! At the very least the United States Department of the Treasury (IRS) will collect enough money to make a dent in the deficit!

Getting old or disabled is not a criminal act or an opportunity for the political elite and their cronies to profit.

    Fight back!

Fight back by flooding your Congressman and Senators with polite, accurate, and informative information concerning the wrong that was done you! 42 USCA 1983 has been violated.

The 'probate exception' that has been carved into the law should not be shield for the criminal activities of Court appointed fiduciaries.

Editor's note: A few lines dedicated to the "Sykes" victims...BEWARE...

    "A damsel with a dulcimer
In a vision once I saw:
    It was an Abyssinian maid,
And on her dulcimer she played,...
    ...
And all should cry, Beware! Beware!
Her flashing eyes, her floating hair!
Weave a circle round her thrice,
And close your eyes with holy dread,
For she on honey-dew hath fed
And drunk the milk of Paradise."

  14. What has happened in the Sykes case is happening in probate court all across our country and is pale compared to many of these cases. Our elderly, especially our wealthy elderly, are being treated as cash cows and all in the name of the almighty dollar. How many lawyers are out there who have the guts to say it like it is, like this one? I think very few. I think those lawyers who do speak up get shut up or shut out.

  18. The Sykes Case is never ending. The Whores of Justice -- the devils-- continue to rape my Mother of her Life, Liberties, and Happiness. She is still isolated at the home of a respondent to a petition for an order of protection The Guardian has filed fraudulent accounting(s), misrepresented the facts to the Court, in the process of selling Mother's home, forcing the sale of my home, seizing all of my money, and ****. No devil in hell and no person in spirit is going to hold me back from saving my mother's life -- witting the laws. The court has pauperized both my Mother and me, and in doing so, they believe they can stop me. My mother has great resolve and courage. I don't care about the money, but my Mother's life. Please join GovAbuse on August 12 at the Daley Center to stop court sanctioned abuse of the elderly, disabled and young.
