Guardianship/conservatorship law is designed to "guard" incompetent people, "conserve" their assets, and "protect" the taxpaying public from the ward becoming a public charge. Over the years, the law has been misused, misapplied, or even manipulated to unjustly enrich court-appointed fiduciaries at the expense of and to the detriment of the very people they are court-appointed to protect.

In the real world, my answer is: yes and yes.
There is exploitation even for the well protected. Why? It's so darned easy to act unethically and get away with it whether it's a one time opportunity or a professional or public guardian with 100's or 1,000's of cases in their history.
The temptations to take and conceal are strong.
I'll never forget what one high profile Chicago probate estate attorney told me long ago:
The ultimate test of a person's character and moral compass is a probate case.
He knew exactly what he was saying and he said most people FAIL.
And in guardianship and conservatorship cases everything is based on the word of the fiduciary with no oversight their word is accepted as truth.
This is a formula for theft.
Think for a moment how the protection system was started decades ago, who was and is involved, who drafts the language of the laws, who benefits and who has the resources, the cash and standing to buy legislation.
Follow the $ and the votes.
Some conservators are bringing in over $1,000,000.00 a year.
That buys a lot of protection and that's just one of how many?

ReplyDeleteJim Beall needs to re-read the constitution. The legislators are supposed to represent their constituents. If the conservatorship needs fixing, and it needs fixing badly, then the legislators need to jump in there and fix it.

nicely done i hope to see more this would be a nice spot for tv seeing all those photos is haunting knowing that none of those people knew this is how their lives would end i give respectful credit to the family members of those faces for making the hard decision to have their loved ones in a public forum but its the only way to show who the victims are and how they ended up as victims of a system that is a mystery to most of society i hope nasga can keep shining the light of truth on a system gone bad
