Linda Kincaid Reports: California Assembly Judiciary Committee vote to curb elder abuse by conservators


San Francisco’s ABC7 I-Team investigated elder abuse by the Santa Clara County Public Guardian. See Public guardian under fire for isolating elderly.

AB937 aims to curb those abuses. See I-Team investigation gets woman more visits, law proposed.
The Declaration of Independence proclaimed that all persons have the right to “Life, Liberty, and the pursuit of Happiness.” However, some conservators routinely violate that “inalienable right” that was so clearly penned by Thomas Jefferson.
  • In Stanislaus County, June Guinn has not seen her family since 2008. The conservator will not disclose June’s location. Family fears that June is dead.
  • In Sacramento County, David Fettgather, a young man with Down syndrome, is allowed to see his father only on alternate weekends.
  • In San Joaquin County, the Public Guardian isolated Maria Jordanou from her family for the last month of her life. Maria died believing her family abandoned her.
  • In Los Angeles County, Helen Kasof was allowed only limited visitation with her son for 15 months.
  • In Santa Clara County, the Public Guardian isolated Gisela Riordan and Lillie Scalia beginning in 2010. Gisela was allowed no visitors, phone calls, or mail for over two years. Lillie was isolated for a year.
  • In San Bernardino County, Jean Swope was taken from her home, hidden from family, and isolated for 15 months. The conservator allowed no visitation and severely restricted phone calls.

This legislation purports to amend California’s Probate Code so as to forbid a conservator from extending the conservator’s control of the conservatee to "personal rights retained by the conservatee, including, but not limited to, the right to receive visitors, telephone calls, and personal mail, unless specifically limited by a court order or necessary to protect the conservatee from abuse". On the other hand, does it prevent a court from issuing an order (thus complying with the legislation) providing the conservator the authority to act in the court's stead to restrict visitors, telephone calls and personal mail?

  3. WOW great news, job well done Linda, a giant step in the right direction. Are we there yet to strengthen the language IN THE LAWS to cover all the problems? No, but a big hurdle has been eliminated. Being believed is a challenge.

    Isolated case? How many isolated cases does it take to show a PATTERN? The opposition is a talking piece a puppet for the Conservators, be aware of their motive and intent to try to sandbag any changes to take away their ABSOLUTE control.

    Financial gain: $$$$$

    Job security: $$$$$

    PEOPLE churned into PRODUCTS to feed the probate machine. Big business the protection industry and these ghouls have their eyes on us, me, you all the Boomers who saved and sacrificed to stash cash, 401K accounts, pension income, valuables etc that will not be YOURS no siree the protection industry has plans how to redirect YOUR assets, possessions, house and all within it, vehicles, watercraft, down to your garden rake will be auctioned off after the good stuff disappears.

    I could write volumes but remember the first action is to seize your mail, bank accounts and change the locks on your residence.

    Sound like a good plan for your so called GOLDEN YEARS? If not get busy and get your papers in order Durable Power of Attorney for property and health care with back up agents to fill in for #1 agent if he/she is unable to serve.

    Be certain to cover yourself with language to appoint a Guardian or Conservator IF the need arises.

    Sign in BLUE INK several original copies of the documents. Notarize all signatures, make copies and wall paper your bedroom and while your at it video tape the signing session. There are ways to beat these courtroom thugs so get moving now.
