On December 4th, a beautiful and brilliant
88-year-old Holocaust Survivor named Marie Winkelman was put into guardianship in the Sarasota, Florida
Probate Court – without a hearing – based upon a mediation agreement.
Marie is a recent resident of Bird Key who still lives independently and
keeps her home in immaculate condition.
The mediation agreement was prepared by Federal Mediator Gary Larsen,
which Marie did not see until after the mediation. Her fortune of many
millions, which she earned through decades of hard work and prudent
investments, is now in the hands of a company named Sabal Trust with which she
has never had any contact. Through the mediated agreement, she is given a
monthly allowance of her own money, despite the fact she has always spent her
money judiciously.
The numerous attorneys involved in her case, including Barry Spivey, Christopher Likens, Kim Bald, Rebecca Proctor, and Thomas Shults, will collect hundreds of thousands of dollars from the Survivor's assets, even though she was denied her due process rights.

Violation of due process is one of the major growing issues of bad guardianship.

ReplyDeleteThis happened to mother in November of 2012. In my mother's situation ,it was my sister who started the proceedings so that she could cover the money that my sister herslf stole from my mother's account. This was in Palm Beach County and my mother is also a holocust survivor. The vulture lawyers and judges are all in on these crimes together. I wonder who did this to Mrs Winkleman.

Yet another pitiful, disgusting story comes forward about a legal feeding frenzy here in Florida! For the life of me, I'm in thorough disbelief these atrocities can ever occur in the first place!!! The entire scam in most all cases, is based ONLY on GREED. Look at all the lawyers involved in this case alone...It's so #*@!% obvious they are not in this to PROTECT this women, nor does she need protecting anyway. I think they all should be sentenced to death for partaking in these outright unlawful acts of blatently slaughtering not just the lives of their prey, but the utter distruction it causes the loved ones. I know first hand, because they kidnapped my precious loved one and now I'm so devastated that sometimes I don't know if I can go on any longer... GUARDIANSHIP ABUSE IS PREMEDITATED MURDER IN MANY CICUMSTANCES. Those who take part in it are psychopaths because they have no capacity to feel empathy which makes them "INCAPACITATED." Our society needs to identify these types of criminals and get them off our streets any way we can to protect ourselves from the evil they carelessly inflict upon those of us who are decent people. God help us to end this madness...!

ReplyDeleteGood question Marcia how did this scheme begin? The court is involved in secrecy this is another example of probate: business deals (most often in secret sessions) being conducted in a courthouse nothing about laws here this is clearly a HOSTILE TAKEOVER.

ReplyDelete"The mediation was ordered by the court, and the agreement improperly stipulated incapacity (without due process). The agreement was filed with the court, never explained to Marie, never signed by Marie, and improperly affects her Trust, among other matters. Marie was never notified of the incapacity and guardianship hearing, in total violation of the law and her due process rights."
The good citizens of the USA need to realize the US constitution is being trashed in state level probate courts the courts of liquidation.
ReplyDeleteProbate court is waiting for the Boomers some jurisdictions are building new courthouses to handle the probate guardianship and estate they get us alive (preferably) or dead.
The end results of guardianship is not what the wards had planned for or even though of during their years of working and saving for their golden years to lose it all in a matter of minutes in a hearing most often ex-parte appointment and it's a done deal a life sentence.
