Man convicted of having sex with incapacitated person

A Walton County jury has convicted Ponce de Leon resident Jerald Stinson of having sex with a mentally incapacitated person.

Stinson, 52, was arrested just over a year ago following a month-long investigation by the DeFuniak Springs Police Department.

He had bragged about having sex with the victim, and investigators obtained a statement from the victim acknowledging sexual intercourse, according to a report filed following Stinson’s arrest.

The victim, though an adult, was not able to give lawful consent to sexual acts, the report said.

Stinson was a long-time friend of the victim’s family.

Circuit Court Judge Kelvin Wells will impose sentence July 19, a news release from the First Judicial Circuit State Attorney’s Office said.

Stinson faces up to 30 years in prison.

  2. In Florida statutes, legal term is "sexual assault" with extra subsets of essentially types; whether against adult or minor, whether by authority figure (police official or prison official or court official) etc. "Defined by statute" and "sexual assault" is the term defined.
