Minnesota nursing home defends rapist: 89-year-old victim was a ‘flirt’

An elderly woman in Minnesota is seeking punitive damages against a nursing home that placed her in a mental health facility and protected her attacker after she was raped.

According to court documents obtained by the Star Tribune, Edgewood Vista senior living facility forced the 89-year-old woman to spend 72 hours in the mental health unit of St. Luke’s Hospital near Duluth after she reported that 30-year-old Andrew Scott Merzwski had raped her in her bed at the senior home.

After the victim’s daughter notified police, Merzwski admitted that he had sex with the 89-year-old woman.

About that same time, the nursing home transferred the woman to a psychiatric ward at St. Luke’s Hospital for nearly three days.

Testimony filed with the court said that the nursing home’s clinical services director, Marilyn Moore, tried to defend that rapist after he had confessed to police.

“Did she tell you that this was consensual?” Moore asked Flesvig. “Did she tell you that she flirts with this boy mercilessly?”

Moore later allegedly told sexual assault advocate Mary Salisbury that the victim was “was making it up,” and described her as a “flirt.”

“I was just shocked that somebody was so blatantly putting the blame on this woman,” Flesvig noted.

  1. Even if the woman was a flirt, that does not relieve the Nursing Home of their obligations.

  3. what what what the nursing home administrators and lawyers who represent edgewood vista need to be in psych lock up they are over the top nuts give me a ______ break here 90 year old woman was taken advantage of by this 30 year old predator rapist is a sick sob i am so enraged i want to throw up on the spin doctors at the edgewood vista nursing home karma to you and your loved ones

    This rapist is not the only one who needs to be in prison.

    Does Marilyn Moore still work at this nursing facility? What professional license does she have to allow her to work as "clinical services director?"

    Is anybody trying to pull that license?

    Why is this nursing facility still in operation given this outrageous behavior?

    AFTER the man admitted raping this elderly lady, they sent the lady to a psych ward -- for what? So she could be drugged up and they could claim it never happened and sweep it under the rug?

    They already knew the truth, so obviously their only motive was to cover up the truth.

  5. Check this out! When my fiance was raped in a rehab facility, APS determined her to be delusional, they then transferred her to psych unit and filed with the probate court for guardian advocate. I was DPoA and health care surrogate but NEVER SERVED NOTICE according to Fl statutes. A week later, they filed for emergency guardian, then of course full guardianship. You know the story now: Isolate, medicate, liquidate her estate while they demonize me. This is the VERY SHORT version of a very long story that will be available to all of you soon. The evil in these scams is beyond all comprehension!!!
