DESTINATION.2.JUSTICE: How and Why It Should Be Important To You

Judicial lawlessness is a nationwide crisis that affects every citizen—no matter: rich, poor, young, old, nationality, political affiliation. Due to the prevalent lack of accountability for abuse of power and influence by attorneys and judges throughout U.S. courts, Americans’ guaranteed inalienable and individual rights to life, liberty and pursuit of happiness under the U.S. Constitution are routinely trampled on day-in and day-out inside the courtroom.

Lisa Siegel Belanger, J.D. created Destination.2.Justice with the objective to facilitate Education & Exposure of the systemically rigged courts throughout the United States.

Throughout Lisa’s career, her passion has always been about trying to right the wrong for “the little guy”. Prior to 2011, her area of practice did not include the Probate & Family Court arena, and therefore, she had no clue as to the rampant judicial lawlessness that went on in the Probate & Family Court forum. That all changed in 2011 as a result of predatory fraud committed by the financial institution BNY Mellon and their crony attorney/judge buddies that irreparably altered her family’s life forever.

In 2011, Lisa’s own elderly father—a man who was a prominent Boston attorney, had a multi-millionaire estate, two loving daughters, and long-time valid executed Durable Power of Attorney and other related advanced planning instruments—was involuntarily thrust into the Massachusetts Probate & Family Court system and “judicially” deemed a “Ward of the State."

Over a decade-long personal battle and extensive research of other like cases in the court swamp of court-appointed guardianship, Lisa’s discovery: her travesty is not an isolated incident but rather she is a posterchild for what is, in no uncertain terms, a business as usual enterprise that exists nationwide in the Probate & Family Court system.

And so, Lisa has been impassioned to help the general public become aware of this nationwide crisis of judicial lawlessness hoping to save other people from having to suffer dismemberment of their family unit by the Probate & Family Court system.

Longtime NASGA member and lawyer Lisa Belanger’s near nine year battle to protect her Father, Marvin Siegel, from guardianship abuse took an extreme twisted turn.

At first, Lisa followed the normal channels, filing complaints (including racketeering) against attorney Marsha Kazarosin (from the law firm of Burns & Lewinson) through the MA Board of Bar Overseers (BBO).

But when those complaints fell on deaf ears, Lisa was forced to go public in a series of articles published by Boston Broadside. and several guest appearances on Marti Oakley's TS Radio Network.  Recently, Lisa appeared in the “Dirty Money” episode on NetFlix - which is seen all over the world. Dirty Money referenced Lisa’s Father’s case as she narrated the tragic and outrageous case of victim John Savanovitch.

Instead of investigating Lisa’s complaints against Atty. Kazarosin, the BB0 is coming for Lisa – to take her law license. (Note: Atty Kazarosin is on the Board of the BBO.)

With the coronavirus affecting courts, it’s possible the hearing to determine Lisa’s future might be held by phone rather than give her the opportunity to look her accusers in the eyes and deny the allegations made against her.

Guardianship - Conservatorship Abuse - Elder Financial Fraud Documentary Guardians Inc.

"Conservatorship is a legal concept in the United States. A guardian or a protector is appointed by a judge to manage the financial affairs and/or daily life of another due to physical or mental limitations, or old age. A person under conservatorship is a "conservatee," a term that can refer to an adult. A person under guardianship is a "ward," a term that can also refer to a minor child. Conservatorship may also apply to corporations and organizations. 

"The conservator may be only of the "estate" (financial affairs), but may be also of the "person," wherein the conservator takes charge of overseeing the daily activities, such as health care or living arrangements of the conservatee. Guardianship: "A guardianship for an incapacitated senior will typically arise where someone determines that a senior has become unable to care for their own person and/or property. In some cases, there may be a belief that the senior is being financially exploited or about to be exploited. In other cases, the person may be unable to care for him or herself and is not able to properly engage in the activities of daily living without assistance. There will typically be a precipitating incident that causes a professional, family member, health care worker or clergyman to initiate guardianship proceedings. 

 "In most states, the process will start with a determination whether the alleged incapacitated person is actually incapacitated. There will often be an evidentiary hearing. Only if a finding of incapacity is made will the next step take place: whether a guardian is necessary and to what extent (e.g. a guardian may be needed for the person's finances but not for the person) and, if so, who the guardian should be. 

The determination of whether a guardianship is necessary may consider a number of factors, including whether there is a lesser restrictive alternative, such as the use of an already existing power of attorney and health care proxy. In some cases, a guardianship dispute can become quite contentious, and can result in litigation between a parent and adult children or between different siblings against each other in what is essentially a pre-probate dispute over a parent's wealth. Stopping the guardianship is often pursued in such cases as well." 

Abuses 

 "A report published in 2010 by the U.S. Government Accountability Office looked at 20 selected closed cases in which guardians stole or otherwise improperly obtained assets from clients. In 6 of these 20 cases, the courts failed to adequately screen guardians ahead of time and appointed individuals with criminal convictions or significant financial problems, and in 12 of 20 cases, the courts failed to oversee guardians once they had been appointed. 

"In October 2017, The New Yorker published an article looking at the situation in Nevada in which professional guardians sometimes have a number of clients, and argued toward the conclusion that in a number of cases the courts did not properly oversee these arrangements. In 2018 the investigative documentary 'The Guardians' was published, alleging 'legal kidnapping of elderly people' in Nevada by private guardianship businesses with no familiar relations, seeking to economically profit from seniors' savings." HOW TO HELP JOHN SAVANOVICH

The “Dirty Money “ documentary episode titled “Guardians, Inc.” (trailer below) is raising awareness of guardianship abuse all over the world.

People who had never heard of adult guardianship are both shocked and outraged that this abuse could and does happen in America to our elderly and adults with disabilities.

This excellent film documents that John Savanovich was targeted because of his age and because he was alone. People are reaching out to NASGA and wanting to help him.

We suggest the best way to help John is to show him that people care about what happened to him --- and that he is not alone. So, we ask anyone who would like to help him to send him a card. A deluge of cards will brighten and strengthen his spirit and surely give him an ear-to-ear smile too!

DIRTY MONEY : Guardians, Inc.

ZigSaw Productions has been working many months on a documentary episode about guardianship abuse which began airing a couple of days ago on Netflix on a documentary show called, "Dirty Money."

Guardianship abuse can be a very complex subject and also hard for people who aren't familiar with it to understand. ZigSaw Productions did a masterful job of condensing a lot of easy to understand information into a one hour show. We are so grateful to them for all of the awareness already being raised (thanks to them) across our nation of the abuse, neglect and exploitation our Seniors and persons with disability can suffer at the hands of their court-appointed "protectors."
