Florida Man Charged With Exploiting Elderly Father

A 51-year-old man has been charged with stealing money from his father, whom he had Power of Attorney.

Hernando County detectives say on or around Sept. 22, they received a notification from the Department of Children and Families that 86-year-old Joseph Prizzi was currently residing in an assisted living facility in the county and his son, Andrew Prizzi, was not paying his bills.

An investigation revealed that Joseph had suffered a fall in the home in early May and was admitted to the hospital at that time.

Andrew indicated to a detective that his father's social security and retirement benefits are deposited into a SunTrust bank account in both of their names, however, Andrew does not contribute to the account. Andrew said that "his father's money is just sitting there."

Detectives then subpoenaed for the bank statements after Andrew refused to hand over any copies.

The statements showed several withdrawals totaling $18,698.26 were made from the account after Joseph was admitted to the hospital.

No payments were made to the assisted living facility or to any of Joseph's physicians. All transactions listed were of no benefit to Joseph. The withdrawal slips on all transactions were signed by Andrew Prizzi.

Andrew Prizzi had a fiduciary duty to act in his father's best interest, including handling Joseph's finances in a responsible manner.

Few would argue that people suffer from mental illness, mental breakdowns, depression or any number of adjectives that describe behaviors that adversely, even severely, affect people's lives. In law it is said that "it doesn't matter what one believes, only what one can prove" The same can be said for psychiatric diagnosing. There’s some good news for one Connecticut teenager who has been away from home for a long time.
Justina Pelletier, 16, was taken from her parents and handed over to Massachusetts DCF in a yearlong dispute over her medical condition. She has finally returned home after a judge earlier this week ruled that she should be with her parents.

Tonight on T.S. Radio: We are Commodities: The Trafficking of Children, the Disabled, and the Elderly






This evening we will be talking about the systems of abuse employed by CPS and APS, and how the courts are instrumental in the kidnapping and redistribution of our children, the disabled and the elderly, all for profit.

 Joining us from Texas will be Joni Saloom, whose son was taken from her as the result of a court proceeding that she was not notified was taking place.

“Joni didn’t learn, until months later by accident, that on Monday, May 07, 2012, Associate Judge Conrad Moren and Judge Lisa Millard switched “primary managing conservatorship” from Joni to Child’s adjudicated father without notice, without a hearing, and without a chance to present evidence or be represented by an attorney.

Her son calls someone else “Mommy” and took classes on how to “grieve for the loss of his [real] ‘Mommy.’

This is standard fair in these kangaroo, family and probate courts.

 These types of activities take place every day across America as our children are bought, sold and traded for money by state agencies.

 This is human trafficking. Just because an agency, an attorney or a bogus “court” is involved, makes it no less the crime that it is.

We are commodities.

Florida: Two State Agencies on Hotseat

The state departments that are supposed to protect children and mentally-retarded inmates are being challenged in the wake of incidents that led to preventable deaths.

First, State Sen. Eleanor Sobel accused the Department of Children and Families (DCF) of a “cover-up and a whitewash” after the agency said no records were generated during an internal investigation into a previous alleged cover-up, the  Miami Herald reports.

Second, there are questions about suspicious deaths of inmates at prisons in the state that were never investigated by the Department of Corrections, the Miami Herald reports in a separate article.

Regarding DCF, the genesis of the cover-up accusation was the discovery that a regional office that covers Broward, Palm Beach and three other counties failed to write and send in reports on the deaths of 30 children known to the agency as being at risk of harm. At the time, last fall and early 2014, the Herald was known to be preparing a report on such deaths.

That report, Innocents Lost,  was published in March. It said 477 children supposedly under DCF watch had died in Florida over a six-year period. The series led to legislative hearings and bills to overhaul the agency.

More recently, the Herald reported that the 30 deaths from Southeast had been withheld from the total. DCF Deputy Secretary Pete Digre was assigned to investigate.

When he finished, Digre said Regional Administrator Dennis Miles may have violated the letter of the law, but didn’t intentionally “shield information from anyone,” the Herald reported. DCF Secretary Mike Carroll gave Miles two days of suspension without pay.

“I can assure you that no information was destroyed, and no child deaths were unaccounted for,” Carroll said.

When the Herald tried to obtain the records of the investigation, Digre and Carroll said there were not any — nothing on paper, nothing digital.

Sobel, a Democrat who chairs the Senate’s Children, Family and Elder Affairs Committee, said the agency is engaging in a huge cover-up to preserve its public image. “They are obstructing information, they are obstructing justice, and they are obstructing transparency,” she told the Herald.

Justina Pelletier's Father says Justina's Returning to Family!

The 16-month saga of Justina Pelletier, who has been at the center of a custody battle between her family and the state of Massachusetts, is expected to end Wednesday.

Justina's father, Lou Pelletier, said Tuesday that he has an order from Massachusetts Juvenile Judge Joseph Johnston saying that she can return home and her parents will regain full custody.

Justina's mother, Linda Pelletier, who has been staying in a hotel near the JRI Susan Wayne Center for Excellence in Thompson where their daughter is being held, got a call from the facility's director around 3:45 p.m., Lou Pelletier said.

The director told her that the Massachusetts Department of Children and Families had received word that custody of Justina would return to her family, he said.

Pelletier said Justina called him from his wife's cellphone and was "screaming" with happiness.

"Right now it's 'Get her home, get the healing going,' then we'll deal with the people who put Justina in this horrific physical condition," Pelletier said.

Justina Pelletier: "Please let me go home right now."

“Please let me go home right now.”

Those are some of the first words that the public has ever heard from Justina Pelletier since she was taken out of her parents custody and into the care of the Massachusetts Department of Children and Families 16 months ago.

“This is the first time they can actually hear her in her own voice,” Rev. Patrick Mahoney told TheBlaze Monday of the video posted to the “A Miracle for Justina” Facebook page, showing the 16-year-old in a wheelchair.

“All I really want to be with is with my family and my friends,” Justina said in the video posted Sunday night.

“You can do it. You’re the one that’s judging this. Please let me go home Judge Johnson and Gov. Patrick,” Justina continued directing her comments to Suffolk County juvenile court Judge Joseph Johnston and Massachusetts Gov. Deval Patrick. “Please, right now. Please let me go home right now. I need to be home with my family and just please do it.”

Scandal-Ridden Massachusetts DCF Agrees to Free Justina Pelletier

The Connecticut girl kidnapped by the Massachusetts Department of Children and Families and imprisoned in Boston Children’s Hospital for more than year has been cleared to return home by the courts. But she has not yet been released, as the legal system continues to drag its feet.

Last week, Justina’s family and attorneys with the Liberty Council filed a motion in Juvenile Court requesting she be returned to her parents, Linda and Lou Pelletier. Massachusetts DCF indicated it would not object to the motion.

In mid-May, Justina was transferred from Massachusetts to a Connecticut facility. Since then, she has been receiving treatment from Tufts Medical Center, the same place she received treatment before her kidnapping by the State of Massachusetts in February 2013.

“Today is a significant event for Justina and the Pelletier family,” Mat Staver, founder and chairman of Liberty Counsel, who is representing the Pelletier family, said May 30. “We believe and hope that the Pelleteir family will soon be reunited.

Hundreds Gathered Saturday to Protest for Justina Pelletier













Hundreds of people gathered on the steps of the Statehouse Saturday, demanding justice for a Connecticut teen in the custody of DCF.

Justina Pelletier has been in state custody for more than a year after a dispute between doctors at Boston Children's Hospital and her parents over her diagnosis.

Justina is now at a facility back in her home state of Connecticut, but still not back home with her family.

Her father Lou spoke at Saturday's rally calling for others around the country to take action. The Pelletiers have a meeting with DCF and doctors from Tufts on Friday.

If all goes well, the Pelletiers hope to have their daughter home by early June.

New Placement gives DCF hostage Justina Pelletier more privileges


CONNECTICUT, May 14, 2014 —  Last Monday, the Commonwealth of Massachusetts moved 15-year old Justina Pelletier across state lines to her new placement at the JRI Susan Wayne Center for Excellence in Thompson, Connecticut. According to the Pelletier family, the move comes as a welcome, but not ideal, change of circumstances for their child, who was removed from their care under highly questionable circumstances last year by the Massachusetts Department of Children and Families (DCF). Yesterday, the family emerged hopeful from a meeting with the Wayne Center, after learning that their daughter would have more privileges, education time, and access to her family in the Connecticut facility.

“The people at Susan Wayne were very nice to us and have assured us that Justina will have more time with her family while we wait for her to come home,” says Justina’s older sister Jennifer, age 22. “But it’s still a three hour trip for us to see Justina at her new placement in Connecticut, which is just as far from our house in West Hartford as Justina’s last placement at the Wayside Center in Framingham, Massachusetts.”

At the time Justina was taken into State custody in February 2013, she was also a competitive figure skater. Currently, Justina is wheelchair bound and has lost much of her hair while in State care, going nearly a year without adequate medical treatment for her deadly metabolic disorder at Boston Children’s Hospital’s psychiatric lock down facility. Throughout the process, Jennifer, a West Hartford skating instructor, has been a staunch advocate for her little sister, regularly meeting with State officials and leaders on Justina’s behalf, and only missed one week of visitation.

“Our concerns for Justina’s medical care are still there,” says Jennifer, who questions whether a psychiatric facility is an appropriate placement for a child with such serious medical issues. She points out that the lack of medical specialists working for the Wayne Center means that Justina’s physical therapist will be an outside contractor who is brought in twice per week to work with her sister, which may not be enough.

DCF refuses to let Justina Pelletier be with her Mother on Mother's Day

Department of Children and Families (DCF) denied the meeting for Linda Pelletier to be with Justina after a request was submitted by the Pelletier's attorneys.
 
Tragically this continues a trend by DCF which has not allowed Justina to be with her family on special holidays and occasions in the past which also included Mother's Day last year.
 
Rev. Patrick Mahoney, Pelletier family Spokesperson, states:
 
"It is hard to imagine that after DCF issued a reunification plan and stated their desire to return Justina home to her family as quickly as possible, they would then turn around and deny Linda Pelletier the right to be with her daughter on Mother's Day.
 
"Every child at Wayside will have the opportunity to see their mother on Mother's Day but one; Justina Pelletier. The question must be asked, If DCF was truly concerned about the welfare of Justina and the family, why would they deny this simple face to face meeting on Mother's Day? One could only imagine what Justina will be experiencing seeing all the other residents spending time with their mothers while she sits alone in her room.
 
"It is now becoming so much clearer that the only solution to this tragedy is getting Justina back into the loving arms of her family as soon as possible."

Justina Pelletier to be Moved to Facility in Connecticut

Justina Pelletier, the sick teen who for the past year has been in state custody under psychiatric care at Boston Children's Hospital, will be moved to a therapeutic facility in Connecticut.

Her parents, Lou and Linda Pelletier of West Hartford, Conn., have waged an angry and highly publicized custody battle for their 15-year-old and continue to fight the state Only allowed weekly supervised visits, they say their daughter was diagnosed with mitochondrial disease by a top doctor at Tufts Medical Center and her condition has deteriorated for lack of proper medical treatment.

They also allege Justina has been “abused and sexually harassed” at the DCF facility where she is being treated.“We are very disappointed,”

Lou Pelletier told ABCNews.com. “There is no end game here and this could drag on with the Massachusetts DCF for months. They are still in charge and controlling this. This is unacceptable.”

 “She is our daughter – this is enough,” he said. “Stop the torture and inhumane treatment of her – and never mind what this has done to our family.”

Pelletier has also pledged to continue a civil rights lawsuit and an emergency appeal in the juvenile appellate court, both underway.

We urge the general public with issues regarding these agencies (Department of Family Protective Service (DFPS), Department of Aging Disability (DADS), Adult Protective Service (APS), Child Protective Service (CPS)) to contact the Sunset Advisory at (512) 463-1300\

WHY SHOULD YOU CARE ABOUT SUNSET?
The Commission seeks public input on every agency under Sunset review and recommends actions on each agency to the full Legislature. The Sunset review of most agencies occur every 12 years, and any negative outcome could have significant long-term impact. Please voice your concerns with the Sunset for these agencies Department of Family Protective Service (DFPS), Department of Aging Disability (DADS), Adult Protective Service (APS) and Child Protective Service (CPS).

Shocking Note Apparently Penned by Justina Pelletier to Her Parents

The Connecticut teen who has been in state custody for more than a year after her parents were accused of medical child abuse after disputing a diagnosis has apparently penned a note, giving a look into how she says she’s being treated.

“They hurt me all the time push me all the time and more,” the purported note from Justina Pelletier says. It also says “[they] do not let me sleep vary [sic] much."

Keith Mason, president of Personhood USA, a group helping lead the Free Justina Coalition, told TheBlaze that Justina gave the note to her parents a few weeks ago.

“There has been some hesitation to release it because of how tyrannical the DCF has been,” Mason said. Mason called the note “troubling” and said it’s “part of the reason we’ve put a lot of urgency on this campaign.”

He said he thinks Justina is referring to her treatment by DCF employees and staff at Wayside Youth and Family Network, a facility in Framingham, Mass., where Justina has been living for the last few months as a ward of the Massachusetts Department of Children and Families.

Lou Pelletier, Justina’s father, told TheBlaze that Justina snuck her parents the note. “She’s very intelligent and figures out ways to sneak us stuff,” he said. “She’s been risking life and limb to get any bit of information to us.”

Justina Pelletier's Parents File Emergency Petition With Supreme Court to Gain Custody

Justina Pelletier’s parents have field an emergency appeal with the state Supreme Court in Massachusetts to regain custody of their daughter.

Today, Linda and Lou Pelletier filed a Habeas Corpus pleading with the Massachusetts Supreme Judicial Court. The detailed Petition and Memorandum of Law requests that Justina be released from the Massachusetts Department of Children and Families (DCF) and be returned to the custody of her parents, Lou and Linda Pelletier.

On March 25, 2014, Suffolk Juvenile Judge Joseph Johnston ruled that the custody of Justina will remain with Massachusetts DCF.

“Massachusetts DCF has no right to hold Justina captive. This is unacceptable. Justina needs to return home,” said Mat Staver, Founder and Chairman of Liberty Counsel.

Staver tells LifeNews that the petition argues DCF has no authority to hold Justina and that DCF’s actions violate the constitutionally protected rights of parents. Among other things, the Petition also argues that the requirement to issue detailed written findings of fact and conclusions of law justifying DCF’s intervention has never been met. Never has the juvenile court issued such required findings of fact or conclusions of law.

“This case comes down to the simple fact that new doctors at Boston Children’s Hospital (BCH), who had no experience with Justina, came up with a different diagnosis than her expert treating physicians at Tufts Medical Center,” said Staver. “The state cannot take children from their parents when the parents make reasonable choices for their medical care. This case is outrageous.”

“The psychological experiment of Boston Children’s Hospital, under the sanction of DCF, has miserably failed. Justina has gone from a competitive figure skater to being confined to a wheelchair,” said Staver.

Alan Dershowitz offers to help #FreeJustina, says law is CLEAR and on the side of the parents


Alan Dershowitz told Huckabee tonight that if everything we know about the #FreeJustina case is true, then this is a horrible abuse of human rights and of civil liberties. He said that Massachusetts law is clearly on the side of the parents, pointing out that if there is a conflict in medical opinion over a child under Massachusetts law, the dispute is settled by the parents, not the hospitals or the state. He even offered to help the parents get custody back of their daughter.

Justina Dying Under Care of Massachusetts

Lou Pelletier, the father of 15-year-old teenager Justina Pelletier is speaking out against a Tuesday ruling in which a judge gave permanent custody to Massachusetts Department of Children and  Families.

A juvenile court judge ruled that the Department of Children and Families has "permanent" custody of Justina, until May 25, according to the Pelletier family's attorney, Matt Staver.

"She needs to be home," Lou told FOX 25's Maria Stephanos. "She is mentally, and more importantly physically, dying under the care of the state of Massachusetts."

On May 25, the judge will then revisit the issue of who is granted custody of Justina in another follow-up court hearing.

Staver said the Pelletier family will now pursue an appeal to send the case to a higher court.

"This is not justice for Justina, or the family," Staver said.

The Massachusetts Department of Children and Families released a statement on the judge's ruling on Tuesday evening.

"DCF's primary goal has always been the health and wellbeing of Justina, and finding a solution that would allow her to return to Connecticut. That has not changed in the face of this ruling," the statement read.
