Tonight on Marti Oakley's TS Radio Network: Australian & American Guardianship Systems Comparison

Doug Young joins us from Australia for a comparison between US and Australian guardian systems.

Australia’s political/bureaucratic/judicial system appears superficially comparable to the US equivalent, however there are a number of significant differences which result in the Australian version of the guardianship racket being considerably more damaging to victims than is the case in the US. Unlike the US where guardians or conservators are private individuals and the functions of financial administration and personal decision-making are combined, the Australian racket involves almost exclusively state government entities like the Office of the Adult Guardian and the Office of the Public Trustee which enjoy total protection and immunity to prosecution.

As a member nation of the UN, Australia is duty-bound to observe international law, however this has never been recognized. Bottom line is that human rights simply do not exist in Australia. The Australian Human Rights Commission has never once addressed an human rights abuse issue involving any state or commonwealth entity, and IMO its director has a substantial history of protecting officialdom.

Chapter three of the Australian constitution defines the structure and function of courts. Guardianship matters are not heard by legitimate courts but rather by non constitutionally legitimate tribunals which have been endowed with native jurisdiction over guardianship matters. Native jurisdiction renders it effectively impossible to have a guardianship matter heard in a ‘proper’ court.

Legislation is produced by the bureaucracy / executive rather than the legislature, consequently it does not include any provision to bring corrupt bureaucrats / civil servants to account. They are effectively laws unto themselves and the legislature and judiciary are impotent to bring corrupt bureaucrats / civil servants to account even if they wanted to.

Our guest is Gretchen Rachel Hammond. a free lance investigative journalist who has been investigating the corruption in Michigan probate courts, most especially in the Detroit area. Recently, Gretchen was advised that she was in serious danger as a result of her investigation. and took precautions to protect herself and her team. One of those precautions was to leave her apartment indefinitely and to sublease it out until she was out of danger and could safely return.

"My source at the Probate Court reached out to me yesterday to let me know that I am now in considerable danger. They did not specify what “danger” entails: an attempt to discredit me before the story is published, the use of the Oakland County Sheriffs to concoct a reason to throw me behind bars (a tactic already used on a rather outspoken activist) or something quite worse. A physical attack was not ruled out. The point is, they have had quite enough of me and, if this were any other time, one might easily laugh it off.”

In a strange turn of events, in Greten’s absence, the person subletting her apartment was found dead inside the unit. Currently, it is unknown what the cause of death was. Is it simply a strange coincidence? Or a case of mistaken identity? Join us as we talk with Gretchen about her current situation and what her plans are as she moves ahead.

They even tried to silence her story by arresting her days after her Dad passed on August 13, 2015.

Having totally monopolized our judicial system, SCOTUS has created its own BAR association that practicing attorney’s must apply to before they can have a case heard before that supposedly independent, constitutionally created supreme court. Judicial oversight boards, and BAR Overseer’s Boards are simply in-house protection rackets which serve to protect union members from being prosecuted for malfeasance, misfeasance and other breaches of duty and law. Having monopolized the entire judicial system both state and federal, the law means nothing. Having granted themselves immunity from prosecution except in the most egregious of cases, 99% of all BAR complaints are summarily dismissed by Judicial Oversight Boards, and BAR Board of Overseer’s.

Its a rigged system and God help the attorney that actually tries to defend their client using the law.

Caroline Douglas, author of "The Dark Side: A Treatise on Law and Judging", joins us this evening to discuss the generating of fees for favored attorneys, which she describes as the "currency of judging". Nowhere is this more apparent than in the probate system. This includes, but is not limited to excessive hourly rates, unnecessary work, unsupervised and questionable billing and approving bills with cursory or no review or audit. This favoritism for specific attorneys also extends to specific and routinely appointed predatory guardians who work with probate hearing examiners, who appear repeatedly together so often in public records on case after case, that no one could look at this information and conclude that some kind of working relationship has been formed that is predicated on profiting from the estates of the targeted victims.

In 2012, Dr. Lillie Sykes White, was entrapped in an involuntary guardianship by a "family friend" in Florida in order to control her Trust. The estranged granddaughter joined forces with him and waged a multi-year campaign to strip away her grandmother's rights. Dr. White called her only living sibling, Janie Sykes-Kennedy, for help and they have been fighting back the granddaughter and a team of attorneys ever since. In Orange County, where the case started, Ms. Sykes-Kennedy was named Limited Guardian and Trustee per her sister's request. Exploitation escalated when the case was moved to Flagler County where Dr. White lived. Judge Margaret Hudson suspended and then removed Ms. Sykes-Kennedy and unnecessarily appointed three court agents--a Guardian, Attorney ad Litem and Guardian ad Litem--all paid out of Dr. White's assets. On August 30, 2016, Dr. White was abducted by the Guardian and Attorney ad Litem and the family has not seen her since--for over two years. The team of attorneys, including the court agents, are billing large sums against her estate. Dr. White's 90th birthday is on September 6, 2018 and the family wants to celebrate with her but they don't know where she is being sequestered. The family is seeking federal intervention.

Helen will also be speaking about the veterans who have asked for help in getting free from forced isolation in this nursing home. While the VA has claimed that it has no guardianship program, the fact is that it does. And the VA has the lawful authority to step in and retrieve these veterans from these homes. The question is: Why don’t they act to protect them from these predators?

The entire Mercedes K. and Chandler H. Kibbee Foundation Fund and ranch were taken by the YMCA (Young Men's Christian Association). Mercedes K. Kibbee wanted her ranch and her fortune to be put to good use and for her ranch to be used as a safe, happy place for disadvantaged children. Instead, bad actors such as First Interstate Bank intervened and converted the foundation and all its assets to their own purposes in the name of the YMCA.

Quoted from the legal documents signed by Mercedes,: "I never gave permission for the foundation to be structured in such a way so as to allow its board of directors to be compiled of a majority of people who are also on the YMCA board.". Documents signed December 12, 2006.

From the Kibbee Foundation Board of Directors, Jay McGuiness who is the Executive Director of the Sheridan YMCA is heard at approximately 1:21 mins into the video, responding to questioning saying, "We own it now! Every vehicle, every tool, every painting"....and he goes on.

Estate theft and theft of trusts is common place in the predatory world of elder abuse by professional people and supposedly respectable institutions and organizations. The most common method used is to levy false charges of incapacity against the elderly individual with assets, to then guardianize the elderly individual and begin plundering the estate.

BRIEF TIMELINE FOR ULYSSES BLACK

My dad was doing extremely well despite his dementia while at his assisted living facility just prior to moving to the Fountains at Franklin assisted living in Southfield, MI around the first of March 2015. Once he moved there my dad was still doing pretty well but things did definitely go downhill. I do not recall a specific treatment plan being put into place upon his arrival, but the facility was supposed to take care of my dad’s needs. After a month or two I signed up with the assisted living facility’s new elderly or geriatric care doctor who was Dr. De Morales, and the ONLY time I ever heard from him regarding the care or care plan for my dad was once right after I signed up with this doctor for my dad who came recommended by the Fountains.

Debbie Dahmer and I will host our third annual World Elder Abuse Awareness Day show. The elderly are being abused, neglected and robbed all across the country. While there are multiple incidents of family and community members committing the abuse, by far the greatest threat to seniors today is the probate tribunal system where their lives are essentially brought to an end....but not before the predators help themselves to the estate.

Isolation, chemical restraint and abuse are common in these situations. While the government and MSM continually refuse to acknowledge who the real predators are, and, that these predators are interested in nothing more than availing themselves of the estate, our elderly languish and die while being isolated from family, friends and even religious associations. Chemical restraints are used to prevent the elderly from complaining or crying out.

This and more while our legislators both state and federal refuse to truthfully address the wholesale culling of the elderly at the hands of a corrupted probate system that operates outside of Constitutional restraints. The elderly, now viewed as a "waste population" are targeted for disposal. Families across the country are demanding a stop to this mercenary system of abuse, exploitation and theft that ends with the eventual misery laden death of an elderly person who committed no other crime than aging with assets.
