Danny Tate got more than sandbagged by the Tennessee Court. There are people who have fallen off the wagon walking all city street every day. It's more than obvious that this case is all about stealing Danny's money!
Note:Danny is already back on the sobriety wagon so if it's noy about his money... why not let him go?

"duly noted " means the court will put it in the record in case at the end of all the bogus hearings that will continue to be held over the next months or years, you can take your complains of being sandbagged up to the very expensive appeals court and tell your story to the judges there, who before they became appellate court judges were judges in the lower courts deciding guardianships and conservatorships.

It is beond me how there judges live with themselves.

Sounds like Danny Tate's lawyer Hoskins is standing tall for him!

Lawyers are so often intimidated by judges. Good to see one who isn't!

Attorney Michael Hoskins rightfully informed the court: "Court has failed to follow the letter of the law".

Now that "the court" has acknowledged "duly noted" there are problems, what will "the court" do about it? and when?

Danny Tate is an innocent gifted young man with many years of productive life ahead of him but instead he is being declared guilty; he is being held down and robbed of his money while the court replies: "duly noted".

2 1/2 year temporary conservatorship is very unusual and a curious situation.

Keep the faith Danny, truth is on your side.

THE COURT said he didn't want to miss the two points, but what did he do? "Duly noted"

Come on judge, the proceedings are supposed to be for Danny Tate's benefit and the conservatorship hasn't been in his benefit. End the farce and let Danny Tate go on with his life!

I think the judge in this case should be debenched. I read "Court-ordered Hell" and it made me sick.

They trampled all over Danny Tate's rights and why? For money.

I am encouraged by reading the exchange between Hoskins and the court.

it breaks my heart and makes me sick to see that others are throwing away Danny's hard earned money on lawyers to incarcerate him in the life of hell of a ward how is this possible and it is going on for how long to what end?

It's interesting that the judge stated Hoskins' objection that the court didn't follow the letter of the law, but then didn't ask for specifics.

Of course, I realize we only have a snippet of the transcript here.

I wonder if the term "sandbagged" is not used in TN case law somewhere??

"Fraud upon the court" exists where an unconscio9nable scheme is used to prevent a party from making their case or defense.

Now, look at these guardianship cases and tell me --- How many wards, at the time of the appointment, get to make their case or defense?? Not many ..... and so my point is this ---

"Fraud upon the court" also exists where "officers of the court" pervert and prevent the judicial machinery from funtionaing as it is intended to perform --- and being "sandbagged" by your attorneys, the court and the judge .... in nothing short of fraud ---

and fraud vitiates all acts and ocurrences touched by the fraud.

Yes, Danny Tate is one of many that are snatched up by this evil system. The first thing necessary is that one has money. Second, they have to be introduced to you through a family argrument or need for a nursing/rehabilitation facility, etc. It helps them a lot if you have slight short term memory loss. Then you are a GONER!!

Sandbagged? I think that would be an understatement. I think Danny was "marked" for destruction. I am watching very closely how this case unfolds. Where there is one who is "marked" there are there others?
