No Right to Life: The Fight for Gary Harvey to be Reunited With His Wife, Sara

Where do you turn when you become disabled, vulnerable, or old and become unlawfully a victim of the system?

There are no kind words for the injustice that Chemung County New York has visited upon Gary Harvey and his wife Sara.

Gary Harvey a veteran who served his country and fought for our freedom is being denied his. Until January 2006, Gary was leading a normal life.

Although Gary Harvey is still a living person, he has not been treated as such since 2006 when he fell down a flight of stairs and sustained traumatic brain injury. Sometime later, his prognosis worsened into a vegetative condition, but this would only be the beginning of his nightmare.

St. Joseph Hospital billed Sara’s private insurance nine hundred and thirty two thousand ($932,000) last year, out of those submitted claims eight hundred ($800.00) were for therapy.

Sar reported the 15 episodes of sepsis in a 2 year time frame to NYSDOH. Neither St. Joseph hospital, nor Chemung County nursing facility has reported this per public health law 2819. Bed sores, and a dislocated hip that Sara recently learned about but was never informed of.

Sara has no say in the matter; the county uses HIPAA as their shield for protection.

She reports it to Gary’s court appointed attorney Kevin Moshier from MHLS and unbelievable his trail goes back to Chemung County Law Department via. Davidson & O'Mara he wrote to her “Some of your concerns might well merit your advocacy, but not necessarily mine”.

Gary Harvey has been institutionalized for more than 5 years and isolated from the love and compassion of his wife.

Gary deserves the love and companionship of his wife, the comfort of his home and friends. Not only is it inhumane to continually deny him quality care, treatment and testing but cruel to continue restricting his wife's visits.

The crime against disabled, vulnerable and elders is growing.

Gary Harvey remains today in the hands of his abusers, the very same people who tried to end his life.

What gets me in so many of these cases is the "ward" is forgotten by his/her guardian. When family contests the guardian's actions, the lawyers churn up their machinery and start in with their legal maneuvering. Meanwhile, Gary Harvey suffers. The proceedings aren't about him anymore.

The attorneys involved here are prime examples. Have they forgotten Gary Harvey? You bet.

Guardianship is the ultimate control of someone else's life.

A stranger has total control of every minute of every hour of every day of Gary's life.

Sara is forced to comply with orders when she is allowed to visit her husband.

Do you hear me? Allowed!!

Allowed to visit with a guard posted to watch her.

And to think Gary served his country putting himself at risk for the ultimate sacrifice.

If he knew then what he knows know, would Gary be a proud Veteran?

I don't think so.

This outrageous situation is a disgrace, shameful and a slap in the face to Gary, a slap in the face to every Veteran who believed he/she sacrificed for freedom.

Let this be a warning to spouses everywhere that your wedding vows are routinely disregarded, sure in the best interest of the ward.

These things are all about money - in one way or another. It's become a pretty sick system, when it can separate a husband and wife.

Send Gary Harvey home with his wife for crying out loud. It amazes me how cruel people can be. Poor Gary Harvey.

Til death do us part well it sounds good during the marriage ceremony exchange of vows I think we need to add to the vows the issue of guardianship destroying a marriage one would think society would demand better than what is happening to Gary.

If he could get up and walk he would go to the courthouse and show them how wrong they are keeping his wife away, far away.

Send Gary home and stop this insult to an innocent person.

How ironic is this the court fights for control of Gary Harvey then they want to eliminate him let him die by taking away his nourishment causing his wife Sara to fight to save her husband from his death sentence at the orders of the guardian? then Sara has to have a guard to watch her, watch her do what? this is beyond insanity someone please explain this to me how this is legal how any of this is ----- in the best interest of the ward? Just who are they fooling? Shame shame shame on you.

It angers me that in our supposedly land of the free, a person such as Gary Harvey can be used like he's a sack of potatoes.

Do they have an ounce of sympathy for Gary Harvey who lies there all damn day alone?

Would any of them offer to trade places with Gary Harvey for a day?

Would any of them allow their loved one to be mistreated this way?

They make me sick.
