In its current format, guardianship can sometimes hinder the self-determination of disabled New Yorkers as these individuals are limited when it comes to decision-making opportunities. However, new legislation I helped pass this year allows supported decision-making as an alternative to guardianship.
The bill, now signed into law, legally recognizes supported decision-making agreements, allowing decisions made by individuals who need assistance to be formally recognized giving them more control over their own lives.
New York state is home to thousands of individuals living with disabilities, all of whom face unique challenges. This legislation can help many of them live their lives more independently. While many people with disabilities depend on guardians for certain decisions, the opportunity to exercise self-representation with the support of a trusted person can also provide greater autonomy.
