What happens when the state steps in and takes custody and control of an adult? Does the family have any rights? What if the custody was the result of shoddy medical treatment? This is one womans story about how poor medical care and her efforts to care for her critically ill husband resulted in the state taking possession of her husband. And what are they doing for him?

Sara filed her guardianship petition on April 6, 2006. In keeping with the due process requirements of a guardianship proceeding "all parties of interest" received notice of the filing. Nowhere in the notice to interested parties was Chemung County Department of Social Services listed as a party of interest. Yet at a court hearing on February 1, 2007 suddenly and without cause or explanation County Attorney Bryan Maggs was present and participated in the hearing.
Why Bryan? Who said you could join? Do you make it a habit or policy of your office to simply butt into purely civil matters?? And if you and the Department wanted in ---- why did you not file a petition as required of you by law???
Oh I get it ..... you don't folloow the law.....
I listened to this interview and my heart was breaking. How can people be so cruel to a helpless person? Do they have any heart themselves? How would they feel if the tables were turned and it was their loved one institutionalized and isolated?
It's sickening.
This is all about a total disregard for the law and greedy and unscrupulous people doing whatever they can to innocent and helpless people.
Yes, Anonymous, Chemung County is beyond unfit. I think they are crimninals.

Sad ... makes me think of the Christmas story of WWI where the two warring sides climbed from their trenches for a Christmas party in the field between the trenches. Only to climb back in the trenches and resume battle after the Christmas party.

I was there, it was a great show!! Sounds to me like Chemung County has some explaining to do!! Soon we should know if the Judge is "for justice" or "for Chemung County" no way can he be "for both!!"

I think the County and the hospital together are just covering up for their wrongdoing and punish Sara for fighting too hard - by way of retaliation by not letting her be with her husband without a "guard" or to take him where she is probably better qualified to care for him.

Don't worry all...I have a message left on my answering machine on exactly how Brayn showed up on my hearing Febuary 1, 2007....Be interesting to see what other media would be interested in listening to this...They know who they all are..because I certainly do. I have the names left on my voice message. Funny how they all worked for the "county" as indicated on my recording.

Gary Harvey doesn't need to be in the hospital. The citizens of Chemung County shouldn't be footing the bill for this unnecessary "stay" in the hospital, when Gary Harvey could be taken care of (better) at home and at less expense to the taxpayers.
Does the Mayor know the taxpayers are been squeezed in this manner?

We believe that the best way to expose this rapidly growing white collar crime in our country is to make a lot of noise. Media attention is critical to inform the public because no one is safe!!
I met Sara Harvey about a year ago after I answered an ad she had on the internet looking for "volunteer guards." After obtaining the Chemung County contact information from Sara Harvey, I called... and I called… There was little to no cooperation on the end of Chemung County to set an appointment promptly but finally, I was granted the appointment where I met with Rita Gould and Diane Giantisco. Chemung County, Gould and Giantisco didn't seem to care that I am CGC Certified guardian with an excellent reputation within our community in fact, they never bothered to call the references that they requested from me. They just promptly turned down my offer to guard “free” saying it was because they read a story about my own mother on the NASGA blog.
My mother is a victim of guardianship abuse. She has literally been kidnapped by a “Professional Guardian” Jetta Getty from Young at Heart Elderly Services in Port Orange Florida while on vacation in Florida. The McKean County Pennsylvania Judge found that my mother was a resident of PA and that there was overwhelming evidence that she wants to return. Well folks, that means she was kidnapped!!

Jetta Getty is intentionally assuring my mother is given dangerous, non approved anti-psychotic drugs to silence her pleas to go home.
Just like Sara Harvey, I will NEVER be silent about this in hopes of protecting someone else’s family.
While my family patiently waits for a court ruling, I can assure you that Christmas just isn’t Christmas without your family & loved ones!!

This is an incredibly tragic story that could happen to any one of us. I take my hat off to Mrs. Harvey for not giving up or giving in. God love her and bless her on her path to justice.

Now, think about that. She takes a picture documenting abuse/neglect and she's kicked out.
But Chemung County can leave Gary basically alone day after day in a stark and void environment, leave him lying flat (dangerous for him), leave him in dirty sheets, and even try to kill him, and nobody's escorting them out.
Yeah, who are you protecting Chemung County?

America must understand this is really happening and must be Stopped ! Marti and Barb, the information relayed to your listening audience by Sara and All the other wonderful, courageous people was riveting. Can only imagine the disbelief and horror in your listener's mind trying to comprehend the corruption that is happening to our disabled and our elders. America is under the illusion we will be cared for and protected by those we have given our trust to... but instead, we find out those we trusted are the ones exploiting, abusing and giving us a death sentence. My God, what has happened to America? Sara, there are many of us that truely want Justice for you and Gary, with all my heart I truely understand, all you've ever wanted is to "Bring Gary Home," to give him peace, comfort and to know someone is by his side that truely loves him. It is time for those in authority to help Sara. Help Sara, bring Gary home...it is such a small request Sara is asking. New reforms and laws must be put in place "Now," to put an end to the injustice happening in our County.
We need and demand accountability. This abuse of powers and arrogance must stop in the sake of our children and loved ones.

The people need to understand that our court system is filled with FRAUD, not always by those that attend court to find justice but by our judges and lawyers. I'm ashamed for having been a police officer for the city of Los Angeles and defending our laws to find that our judges have lost their pride and integrity. They should be tared, feathered and held to a higher standard. My personal experience is with David P. Yaffee, Aviva K. Bobb and Candace Beason of the Los Angeles Superior court system. These judges have been involved with bribery, theft, embezzlement and even murder. Some are doing this to our seniors in the probate division that is suppose to protect us. Conservatorships are CON-Servatorships where lawyers and judges ignore justice and rob weak, defenseless seniors of their life savings. Yaffee a low life judge who was caught accepting bribes to rule against the people of Los Angeles. If it were me I'd ask they all be hanged for their crimes and the people of the USA revolt. Citizens of the USA you need to see what is going on with these BAD lawyers who are then made BAD judges.

My mother is locked away in a Pasadena Dementia home. Several doctors have stated she does not have dementia. My sister perjured her petition so no one would object to her becoming conservator. Sylvia Schmidt, Christopher Overgaard (her lawyer)and Violet Boskovich PVP for Gertrude Gettinger (my 86 year old mother). The court was legally informed and did nothing, in fact they forced this into a trial which they would not let me win. Sylvia the person who perjured her petition was paid $84,000 by my mother estate to help her lie, cheat and fight the documents, proof, witnesses and facts. This should have been a fair and easy case. Conservator LIES. Conservator Steals and Conservator tries to KILL her mother. With proof, documents and witnesses what does the judge do? NOTHING, she ignores everything, even the PVP court appointed lawyer Violet Boskovich lies to the court, now claiming Elder Abuse at the whistleblower. Without any evidence, a total lie. The system is broken, the court does not have control over 1 penny of our mothers estate. They say they do but 2 million dollars is not in a blocked account. Plus $200,000 was never reported to the court and is missing. The missing account numbers were given to the court which they ignored. This is how our courts work today. They don't care, they are based on greed and profit. Seniors of the world BEWARE.
Are judges immuned under the ADA? Anyone know? These guardianship victims sure would make great SCOTUS cases to file.
