Carol Burnett’s Estranged Daughter Reunites With Son 8 Months After Being Stripped of Visitation

Carol Burnett’s estranged daughter, Erin Hamilton, saw her son Dylan for the first time in nearly a year — after a judge suspended her visitation with the teen — and In Touch has exclusive photos of the reunion.

Erin exclusively tells In Touch she had lunch with Dylan over the weekend— who graduated from high school on Friday.

In August 2023, a Los Angeles Superior Court judge cut Erin’s ability to contact Dylan after she was accused of violating a court order.

Carol, 91, filed to be named co guardian of Dylan in 2020 with her husband, Brian Miller. She claimed Erin was not a fit parent due to her addiction issues.

“In the past 19 years, Erin has been in and out of rehabilitation centers and has been institutionalized a total of eight times for a minimum of 30 days each time,” the entertainer’s petition revealed. The court signed off on Carol and Brian’s petition. The duo then appointed a third party named Jodi Montgomery, who worked on Britney Spears’ conservatorship, to take over as guardian.

As part of the guardianship, Erin was allowed visitations with her son. Last year, the court-appointed lawyer for Dylan accused Erin of breaking the rules by “accidently” running into Dylan while he was out with his father. The lawyer asked the judge to suspend Erin’s visitation due to her “erratic and unpredictable conduct.”

The judge signed off on the request and set a hearing for early 2024 for Erin to make her case for visitation to be reinstated. The hearing was then postponed till September. Following the postponement, Erin’s lawyer pleaded for the matter to be heard immediately and not months down the road. Carol’s daughter said she was sober and desperately wanted to see her son before he left California for college on the east coast. She asked for permission to attend his graduation.

“I am hardly a danger to my child. I have been drug/alcohol tested consistently since moving back from Hawaii and I work with people in treatment and I must remain completely sober in order to keep my job. I love my job and I love being sober,” she said.

“I miss my son terribly, and I feel that this is a punitive situation brought on by people trying to keep me away from my son until he moves out of state. There has been no attempt from my family members involved in this court case to get to know who I am today. I am not the same person that I was,” she added.

Erin added, “I have a sponsor in AA and I also sponsor three women. I am an active member in this 12-step program and I take my sobriety seriously.”

Despite her emotional plea, the judge shut down Erin’s request to attend Dylan’s graduation. However, as In Touch first reported, weeks later, Dylan’s guardian Jodi agreed to allow Erin a 1-hour lunch date with Dylan following his graduation.

“If all goes well with the visitation then, in the Guardian’s sole and absolute discretion after consulting with [Dylan], [Dylan’s] counsel, the monitor, among others if needed, further visitations can be scheduled before [Dylan] leaves California for college,” Jodi said in her filing.

No decision has been made on Erin's visitation being fully reinstated.

Comedian Carol Burnett’s Estranged Daughter Scores Small Victory in Fight to Regain Visitation of Son

Comedian Carol Burnett’s estranged daughter Erin received good news in court this week as part of her effort to regain visitation with her teenage son — months after being accused of “erratic behavior," In Touch can exclusively reveal.

According to court documents obtained by In Touch, Jodi Montgomery, the guardian appointed by Carol, 91, and her husband, Brian Miller, to take care of Erin’s son Dylan, signed off on Erin visiting her teenager. Erin will be allowed one monitored lunch visit with Dylan. The date and time have yet to be determined. A monitor will be present during the 1-hour visit.

Jodi said the deal would be off if Erin attempted to contact Dylan before the scheduled meeting.

“If all goes well with the visitation then, in the Guardian’s sole and absolute discretion after consulting with [Dylan], [Dylan’s] counsel, the monitor, among others if needed, further visitations can be scheduled before [Dylan] leaves California for college,” Jodi said.

Back in 2020, Carol and her husband filed to be named co-guardians of Dylan. The couple claimed Erin had struggled with addiction issues for years and was unable to properly take care of her son. “In the past 19 years, Erin has been in and out of rehabilitation centers and has been institutionalized a total of eight times for a minimum of 30 days each time,” Carol said in her petition.

The couple said Dylan’s father was also not a suitable guardian. The court approved the petition. A couple of weeks later, Carol and Brian appointed Jodi to take over their roles. As part of the guardianship, Erin was required to follow a strict set of rules to communicate with her son. Last year, a court-appointed lawyer accused Erin of breaking the rules by “accidentally” running into Dylan when he was out with his father.

The court-appointed lawyer demanded visitations be suspended due to Erin’s “erratic” behavior. Earlier this year, Erin claimed she had been clean from drugs for months. The court recently shut down her plea to attend Dylan’s graduation despite her emotional plea.

“I am hardly a danger to my child. I have been drug/alcohol tested consistently since moving back from Hawaii and I work with people in treatment and I must remain completely sober in order to keep my job. I love my job and I love being sober,” Erin said. Erin claimed her famous mother had iced her out completely.

“I miss my son terribly, and I feel that this is a punitive situation brought on by people trying to keep me away from my son until he moves out of state. There has been no attempt from my family members involved in this court case to get to know who I am today. I am not the same person that I was,” she said.

“I have reached out consistently to my mother telling her how I’m doing and although I respect and understand her decision to not be in my life, it is punishing to both Dylan and myself. I have a sponsor in AA and I also sponsor three women. I am an active member in this 12-step program and I take my sobriety seriously.” Carol has yet to respond in court.

‘Flagrantly Violated’: Lawyer Fighting Carol Burnett’s Daughter Erin’s Plea for Visitation With Son Despite Claims of Sobriety

Carol Burnetts daughter Erin Hamilton was slammed by the guardian representing her son Dylan after she pleaded for visitation to be reinstated.

According to court documents obtained by RadarOnline.com, Dylan’s guardian, Jodi Montgomery, opposed the recent emergency motion brought by Erin.

Carol and her husband Brian filed to place Dylan under a guardianship in 2020. The comedian claimed her daughter had a long history of addiction issues. She said Erin was not a suitable parent to raise her grandson nor was the child’s father.

The court appointed Carol and Brian as co-guardians until they hired Jodi to take over.

In this case, Erin was awarded visitation with Dylan. She was allowed monitored Zoom calls. Last year, the visitation was suspended after the court-appointed lawyer for Dylan accused her of violating the court order.

The lawyer claimed Erin had “run into” Dylan and his father while they were out. The trio then had dinner. The lawyer said this was against the rules and asked that visitation be suspended due to Erin’s “erratic and unpredictable conduct.”

The court agreed and suspended Erin’s visitation.

As we first reported, this month, Erin pleaded with the court to reinstate her visitation and allow her to attend Dylan’s upcoming high school graduation.

Erin said she has been sober for months. She complained that the hearing on her visitation has been pushed to September — which would make it one year since she spoke to her son.

Erin’s lawyer wrote, “There was no evidence of any danger to the child presented that would be resolved by prohibiting the monitored, remote viz Zoom visitations. Moreover, stopping all contact for a year is draconian as well as punitive. The hearing where the order was issued terminating all visitation was not even a hearing on the visitation issue – it was an annual status report hearing.”

He added, “There was no showing of any danger from the monitored remote visitations. Accordingly, it is appropriate and the right thing to do to reinstate Ms. Hamilton’s monitored visitations and allow her to attend her son’s graduation in May.”

In a declaration, Erin wrote, “I am hardly a danger to my child. I have been drug/alcohol tested consistently since moving back from Hawaii and I work with people in treatment and I must remain completely sober in order to keep my job. I love my job and I love being sober.”

Now, Dylan’s guardian Jodi demanded the emergency motion be shut down.

Jodi argued there was no real emergency and Erin could wait until September. She said she needed to present witnesses and evidence at the upcoming hearing.

She said, “This Ex Parte is an attempt to end-run around that upcoming evidentiary hearing by asking that all the substantive issues to be decided at it be decided now instead, on the papers.”

“The Guardian needs her own opportunity to present witnesses and evidence, as well as to cross-examine Applicant’s witnesses,” she added. “This case has a long history of Applicant violating the Court’s visitation orders and, even to her own admission, Applicant’s claimed sobriety is only 6 months’ long.”

Jodi said Erin had “flagrantly violated” the court order numerous times. “Guardian is further informed and believes that Applicant’s violations of this Court’s visitation orders are still occurring with unmonitored contact, as we will show if an evidentiary hearing is scheduled upon this Ex Parte,” she said.

In addition, Jodi said Erin’s lawyer claimed in August 2023 that Erin was living at a sober living facility. “Further investigation revealed that this was false,” said the motion.

“Applicant has a long history of struggling with her drug and alcohol addictions. While Guardian certainly wishes that Applicant’s current claims to be clean and sober are true, sadly Applicant has made these claims before, and her periods of sobriety have been short-lived,’ lawyers for Jodi wrote.

Jodi argued the matter should be heard in September. She said if the court allows Erin to attend the graduation there should be strict rules in place.

The judge set a hearing for next week.

Carol Burnett’s daughter Erin revealed her unsuccessful attempts to mend her relationship with the comedian as part of her court battle to see her son Dylan.

Erin submitted an emotional declaration as part of her plea to the court to reinstate visitation. As RadarOnline.com first reported, in 2020, Carol and her husband Brian Miller filed a petition to place Dylan under guardianship.

The entertainer said her daughter struggled with addiction and had been recently placed on a mental health hold by authorities. She said her daughter was in no shape to care for Dylan. Carol said her grandson’s father did not have a suitable home.

The court approved the petition. Carol and her husband were appointed as co-guardians until they hired a third party named Jodi Montgomery to take over.

Erin was granted visitation with Dylan but had a strict set of rules to follow. She was not allowed to contact Dylan without the court’s approval or the guardian being aware.

A court-appointed lawyer for Dylan accused Erin of violating the rules. He said Erin “ran into” Dylan when he was spending time with his father. The three had dinner together. The lawyer said was against the rules and demanded the visitations be suspended.

The court agreed and ordered Erin to have no contact with her son, until a future hearing, in August 2023.

As we first reported, Erin’s lawyer filed a motion this week demanding the visitation be reinstated. He argued that his client was not a danger to Dylan. In addition, he pointed out the hearing on the matter had been pushed multiple times.

In her declaration, Erin explained she was desperate to reconnect with Dylan. She said she had been sober since July 27, 2023 and passed a drug test last week.

She said, “I have had troubles in the past. I take full responsibility for my actions that have caused a tremendous amount of pain and suffering for members of my family and friends that love me.”

Erin expressed her frustration with the court hearing being pushed to September.

She said, “my son will be turning 18 at that time and moving to New York to go to college. That would make it so that I wouldn’t have any contact with him whatsoever and yes he would be moving out of state and I would be missing his very precious high school graduation.”

“I am hardly a danger to my child. I have been drug/alcohol tested consistently since moving back from Hawaii and I work with people in treatment and I must remain completely sober in order to keep my job. I love my job and I love being sober,” she said.

In the declaration, Erin revealed her attempts to reach out to her famous mother.

“I miss my son terribly, and I feel that this is a punitive situation brought on by people trying to keep me away from my son until he moves out of state. Erin told the judge, ‘I cannot go back in time, and I can just move forward with a positive loving, and sober breath. my son is incredibly important to me and I have already missed so much precious time with him, and I just want to be back in his life on our terms.”

She ended, “I am not a danger to my son – especially with monitored Zoom visitation. I am certainly not a danger to him by being able to attend his graduation. Dylan should be asked – not just a bunch of high-paid lawyers and a fiduciary who have been paid to keep him away from me. Yes, I have had problems in the past, but that doesn’t mean my son should be taken completely away from me where I have no visitation for over a year. Visitation and custody are not supposed to be used to penalize someone.”

The judge has yet to rule on Erin's request for an emergency hearing on the matter.

Former Spears Figure Named Permanent Guardian for Carol Burnett's Grandson

LOS ANGELES (CNS) - The same woman who until recently served as Britney Spears' temporary personal conservator was appointed today as the permanent personal guardian of comedian Carol Burnett's teenage grandson, whose mother allegedly has a history of drug abuse.

Los Angeles Superior Court Judge Deborah L. Christian had previously named Jodi Pais Montgomery as the temporary guardian for 15-year-old Dylan

Hamilton-West on Nov. 10, when Montgomery took over for Burnett, 88, and her spouse, Brian Miller, who had served in that role since Sept. 1, 2020. During Friday's hearing, the judge noted there was no opposition to naming Montgomery to the position on a permanent basis.

``Dylan is very much in agreement... and happy with the current arrangements,'' the judge said.

In their original petition filed in August 2020, Burnett and Miller stated that throughout her adult life, and since Dylan's birth, Burnett's daughter, Erin Hamilton, has suffered from severe substance abuse and addiction issues and that in the past two decades, she has been in and out of rehabilitation centers while being institutionalized a total of eight times for a minimum of 30 days each time.

Dylan's court-appointed lawyer, Stefanie Bennett, stated in a report to the judge filed Tuesday that Montgomery was suited for the role or permanent guardian. Montgomery made a virtual appearance during the hearing along with Miller and the boy's father, Tony West, but Burnett and Dylan did not participate.

``I spoke with Dylan and I asked him to go to school,'' Bennett told the judge in explaining that her client had waived his appearance.

Bennett wrote in her report that during her representation of Dylan, she spoke with the teen along with Burnett and Miller; the couple's lawyer, Gabrielle Vidal; the boy's parents; and Montgomery, getting the input of all and concluding that naming Montgomery as Dylan's permanent personal guardian was in his best interests.

``Dylan is of the age and maturity to understand the role of his guardian,'' Bennett stated in the report. ``Dylan is in agreement with Jodi assuming the role of his guardian.''

The judge approved Bennett's recommendations for monitored visits by Dylan with his mother and brother and that all of the monitors be approved by Montgomery. The costs of the monitors are to be born by the sibling or mother.

Bennett told the judge that ``visitation'' should apply to all contact Dylan has with his mother and brother, including communications such as the telephone and the social media, because the teen recently viewed comments that were upsetting to him.

Dylan has liberal visitation with his father.

Montgomery became a part of Spears' conservatorship team in September 2019 after having previously served as her care manager. The Spears conservatorship was ended by Judge Brenda Penny in November.

Hamilton, a 53-year-old singer, is one of Burnett's three daughters from her marriage to television producer Joe Hamilton. Their oldest daughter, Carrie, died of cancer in 2002.

In July 2020, Hamilton sent Dylan and her adult son multiple text messages threatening suicide, according to the original petition, which says she was subsequently placed by the Los Angeles Police Department on a hold for ``suicidality and drug use'' before being released late that same month.
