Closure Eludes Victim's Family

More than three years after the shocking broad-daylight murder of Tammy Lynn Texiera at a Roseville gas station, family members say they are still waiting for justice.

Declared mentally incompetent to stand trial, the accused killer, Erik Minchak, remains at Atascadero State Hospital. But the time is fast approaching when a judge must decide whether to place Minchak, 30, under a civil conservatorship that Texiera’s family members worry will remove any possibility he will ever have to answer to his charges.“He could still be functioning and enjoying his life and watching TV and reading books, while Tammy’s gone,” said Bryan West, whose son is married to Tammy’s daughter. “That’s kind of hard to swallow.”

Here we go - I am constantly amazed by how guardianship is used these days. The old days of locking someone up in the insane assylum have been replaced with guardianized.

In this case, sadly, Erik Minchak will likely truly be "protected".

Very creative way to use guardianship system to pamper and protect the perp defendant Erik Minchak while the family and friends of the murdered victim will take this injustice and pain to their graves.

I assume the prosecutor isn't pleased with these developments either.

My deepest sympathies to the Texiera family.

I too am sorry for this family. Nothing will bring back Tammy Lynn Texiera, but justice would at least allow these people to sleep again.

If this guardianship scheme is allowed to proceed to conclusion, there will not be justice for Tammy Lynn. I hope and pray her family can find peace and strength within their hearts knowing they did all they could, that was humanly possible for their daughter.

Stand Up, you are so right. This man will get a Guardian Attorney paid for by taxpayers! Lock his butt up in prison where he'll get all the 'services' he needs. No need for the taxpayers to pay exhorbitant 'lawyers' fees for doing nothing.

This case isn't about Justice, it's about fattening the wallet of the Attorney Guardian and the State's coffers. State governments receive federal kickbacks for individuals with mental illness in their custody as
'wards' of their state run facilities. CT's state run facility for it's in patient mentally ill is almost a million dollars per patient.

It's just about The Money!
