Batavia woman gets probation for stealing from elderly mom


A 44-year-old Batavia woman convicted of stealing more than $20,000 from her mother in 2009 and 2010 recently was sentenced to probation and community service, according to Kane County court records.

Monica Ogen, of the 0-99 block of North Mallory Drive, was convicted over the summer of financial exploitation of an elderly person, a felony.

Judge Susan Clancy Boles sentenced Ogen this month to four years of conditional discharge, which is a form of probation, and 160 hours of community service, records show. Ogen also must pay $8,070 to the estate of her mother, who died in 2012.

According to prosecutors, Ogen used the money to buy clothes and go to restaurants and bars. She once dropped nearly $2,300 on flooring at Home Depot as well, authorities said.

If Ogen violates her probation, she could be resentenced to up to seven years in prison.

Ogen confessed under oath to her actions and wrote an apology letter to her mother, prosecutors said.

TX Pastor David DeFor Sentenced for Bilking Elderly Woman

An Austin pastor accused of bilking an 82-year-old woman with dementia out of more than $40,000 has been ordered to pay $17,000 restitution and placed on 10 years probation.

The Rev. David Vernon DeFor had been charged in June 2013 with four felony counts of financial exploitation of a vulnerable adult. He pleaded guilty in June 2014 to one of the counts; in exchange for the plea, the other three were dismissed.

 
The sentence was handed down Friday in Mower County District Court. District Court Judge Bernard Borene also ordered DeFor to complete 80 hours of community work service.
 
DeFor, 70, is a pastor at Austin Church of Christ (Christian). He and the victim initially became friends while serving on the Salvation Army Board together about seven years ago, according to the court complaint. DeFor was granted power of attorney for the victim on July 27, 2010.

CA: Ex Lawyer Ricardo A. Torres Pays Restitution, Placed on Probation

Disbarred Los Angeles attorney Ricardo A. Torres II has been placed on probation for stealing from clients, a district attorney spokesperson said yesterday.

Los Angeles Superior Court Judge George G. Lomeli sentenced Torres Friday to five years’ probation, the conditions of which include 300 hours of community service. Torres pled guilty to one count of embezzlement, in violation of Penal Code Sec. 506, in September.

State Bar spokesperson told the MetNews that Torres last month paid over $97,000 in restitution to the State Bar for funds paid out by the Client Security Fund to Lawrence and Rachel Prijoles, plus interest. Torres, whose proffered resignation from the State Bar was rejected by the Supreme Court, agreed in 2011 to be disbarred and to pay restitution to the Prijoleses or the fund.

According to the disbarment stipulation, the Prijoleses were involved in a head-on collision with a drunk driver in San Diego County in 2005, winning a verdict for more than $500,000 in compensatory damages. The driver then agreed to pay $125,000 to settle the punitive damages part of the claim.

Torres received checks totaling nearly $650,000 from the driver and the driver’s. Of that, nearly $560,000 was disbursed to Torres, his co-counsel, expert witnesses, and the clients.

None of the medical providers were paid, and Torres admitted misappropriating the remaining $89,000 in settlement funds.

The Client Security Fund has also paid $27,100 on four other applications filed against Torres, the State Bar spokesperson said'
