"My Dad Has Alzheimer's"

The daughter of Hollywood legend Peter Falk says her father is no longer competent to run his own life because he suffers from Alzheimer's disease and dementia.

Catherine Falk filed legal papers in L.A. County Superior Court claiming her father "requires full-time custodial care for his health and safety."

In the docs, Catherine claims she is worried her father "can easily be deceived into transferring away property" and believes a conservatorship will protect Peter from "fraud or undue influence."

A hearing on the matter is set for next month.

The Falk family has taken a head first dive into the quicksand which is conservatorship.

Unfortately, they will find out too late that they've been misled- and it will be too late.

This is heartbreaking.

If only they'd found NASGA first, before making this bad decision....

Alzheimer's is a disease that can only be diagnosed upon autopsy.

We must be careful with the words we use.

If Mr. Falk has lost his short term memory --a common problem, then he mustbe protected of course.

But his money should be used for his comfort --not "conserved" for his heirs.

Oh, how sad. He is one of my favorite actors, I liked him and I loved the show Columbo.

And, even sadder I find it interesting that Falk's wife isn't mentioned and the fact that Falk's daughter has initiated a hearing to declare her dad a ward of the state, which will immediately strip him of all of his rights and his assets.

Here we go, again........next case.

The lawyers just might end up with Mr. Falk's estate, leaving Mr. Falk and his rightful heirs a mountain of $00.00's and life long regrets.

Watch out!

The probate racket is all about the $$$$$ for the probate club and the ward is the "host".

Why does he need something as drastic as a conservatorship? If he truly needs to have his money protected there are much better alternatives to the a conservatorship will which take away all of his rights and basically make him a non-entity.

This is such sad news. I spoke to Mr. Falk when I was a teenager. He was very kind to me and in no way acted like a "celebrity". Hopefully his daughter is petitioning to be his conservator for the right reasons. I don't believe that conservatorships are necessary, as they completely remove a person's rights and he basically becomes a non-entity. There are better alternatives out there. However, if a conservatorship is needed, I believe that family is the logical choice. Outside conservators that are in it only for the money have made the whole conservatorship system an unforgivable scam of the elderly.

He himself soes not need any conservatorship. His daughter needs guardianship over him! And even if he really needed a one what's the big difference? The law is completely perverted regardless of whether he needs one or not.

If you think the judge will take into consideration that he had cut off his daughter out of his life because she had already proven to be a greedy leech, you are wrong. He won't.

The same was with Spears when the commissioner appointed her father as her conservator though he had been an alcoholic and a very abusive type when Britney was a child.

If Peter's wife had filed the papers before his daughter did this, she would have more chances. But the daughter was the first and she is younger, so the courts would rather grant the conservatorship to her because the conventional wisdom (stupid wisdom if I may say so) considers younger people more fit to protect disabled and to take care of them than older ones. Which is completely wrong because young people has their own life and one must be a fool to believe that they will sacrifice everything to be a full-time nurse, manager and entertainer of an ill Dad or Mom.

There exist such kids in the World. But they usually don't need conervatorships because they are driven by love, not greed.

Interesting! In all the cases we hear about, the phrase "fraud and undue influence" is not the usual causative factor for a conservatorship or guardianship.

The irony is that "fraud and undue influence" are now brought into play by the process itself!

Frankly speaking I don't believe in the sincerity of the relatives' intentions either. Spears' father is being paid 10K per month as her conservator that amounts to 120 K per year. I may be wrong but isn't that far above the average annual income of a cook (which is his job in fact)? Can you really expect he may give up such a profitable job as this conservatorship voluntarily?

Moreover, he was a BANKRUPT cook AKA a bankrupt owner of his own small business. And the court gave him the right to control a megabuck fortune of his young and sane daughter.

The same is with Peter. No matter how sane you are and whether you are competent or not. Conservatorships are granted easily and thoughlessly.

It reminds me of the situation in the 70-ies in the Soviet Union when people were taken to psych wards and were deliberately misdiagnosed with mental diseases just because they were in opposition to the Communist party.

In Spears' and Falk's cases the reason for malpartice is different.

It is about assets control and not political control.

It's about greed and not paranoia of an Orwellian society.

But the essence of the problem is the same: law. does. not. protect.us.

All of this is by design, it's all about the money - a power struggle over control of the ward and the ward's assets.

Step # 1 - take away the rights of the "mark", the future ward, with court approval

Step #2 - conservator/guardian of estate seizes every last penny and spends every last penny according to their wishes

Step #3 - file appropriate papers for the taxpayers to pay all of the bills by because the ward needs to receive Medicaid since the ward is now destitute via the probate racket.
