State Rep. Gidley seeks to disqualify elder abusers, exploiters from receiving inheritance

State Rep. Mark Gidley (R-Hokes Bluff) is seeking to remove the ability of individuals to receive benefits or inheritance from people they have been convicted of abusing or financially exploiting.

Current law prohibits a person from receiving any benefits under someone's will or intestate succession if they are feloniously responsible for their death. Intestate succession describes when the state distributes assets to the surviving family if no will exists. The prohibition also applies to contracts.

House Bill 66 (HB66) would provide that any individual who is convicted of elder abuse or financial exploitation of an elderly person may not receive any benefits under the abused or exploited individual's will or through intestate succession. It would also cause a person convicted of abuse to lose any property interest in any joint venture held with the abused or exploited individual.

If convicted, a person would not be allowed to collect life insurance, inheritance, property or collect on any contracts made with the person they were convicted of abusing or exploiting.

According to the bill, an individual will be deemed to have abused another if the individual is convicted of elder abuse and neglect in the first or second degree or financial exploitation of an elderly person in the first or second degree.

PITT COUNTY, N.C. (WITN) - A Simpson woman is facing nearly 100 charges after deputies began investigating claims of financial exploitation of an elderly Pitt County resident.

Pitt County deputies on Tuesday arrested 42-year-old Dekedriya Maye. She is charged with 31 counts of identity theft, 31 counts of obtaining property by false pretense, and 31 counts of financial exploitation of an elder by a person in a position of trust.

The total amount involved was $1,800 and took place over a three-month period late last year.

Maye remains in jail on a $300,000 secured bond.

Carthage man pleads guilty to cheating elderly victim

A Carthage man pleaded guilty this week to financial exploitation of an elderly Webb City resident.

Brian E. Neher, 40, pleaded guilty to the charge at a hearing Monday in Jasper County Circuit Court in a plea agreement with the prosecutor's office. The state has agreed to dismiss a related count of receiving stolen property in exchange for the guilty plea.

Circuit Judge Gayle Crane delayed formal acceptance or rejection of the plea deal and ordered a sentencing assessment of the defendant. The judge set a sentencing hearing for Sept. 10.

A probable-cause affidavit filed by Detective Keith Meyer, with the Webb City Police Department, states that Neher accepted $2,500 cash and a check for $1,400 as payment for the purchase and installation of Ruud 80,000 BTU heating and air conditioning unit at the victim's residence on Goldpan Drive.

The affidavit states that Neher never installed any unit for the victim and never returned any of the money.

Woman Arrested Again in Exploitation Case

DUNBARTON, NH — A local woman arrested recently for allegedly financially exploiting an elderly, disabled, or impaired adult, has been arrested again, this time, for felony witness tampering.

Giselle Lemieux, 48, a homeless woman with no fixed address who is currently incarcerated, was arrested on May 10, 2017, on the charge. According to Dunbarton Police, Lemieux – who is being held on $4,000 cash bail at the Merrimack County House of Corrections – is previously facing “numerous charges” connected to the original case.

The charges include financial exploitation of an elderly, disabled or impaired adult, bail jumping, criminal mischief and five counts of default or breach of bail conditions, according to Sgt. Chris Remillard of the Dunbarton Police Department.

While she was previously out on bail, police allege, “Lemieux contacted the victim, stayed at the victim’s home and violated other conditions of her release,” Remillard stated. During the course of the continued investigation, police reportedly learned that Lemieux allegedly called the victim from jail on March 9, after initially being arrested. A warrant was issued for the new charge this week.

Lemieux was processed at county and refused bail. She’s expected to be arraigned later today.
