Sixty-four-year-old Stewart Rosenkrantz landed in a wheelchair decades ago, after a car accident, but he hasn't let that stop him from enjoying life. His still pictures are so special he's sold them. His money management is so good he owns his home and doesn't owe anybody anything.
Edward Dinna, Attorney: "Mr. Rosenkrantz is the only fellow I know that doesn't have a debt."
Attorney Edward Dinna represents Stewart. They're fighting a move by a family member that could cost Stewart control over his life and his finances. It started with this, a petition filed in Broward County that claims Stewart is being unduly influenced by his roommate. A claim Stewart and his attorney deny. Edward Dinna: "Not only are they trying to appoint a temporary guardian, but they're trying to serve subpoenas on all his banking and financial institutions to find out just how wealthy or not he is."
Three court appointed members of a committee met with Stewart and he can own a gun, he can drive his van, but he can't manage his property. He says it's all about getting control of his money.

Carmel on the Case: Guardians

As Stewart said, "I didn't even know what the guardianship program was." Unless you are a victim of this corrupt program OR making a living from it, you are unaware... you DON"T KNOW WHAT IT IS!!
It's obvious Stewart has been targeted for financial exploitation and anyone in that position would appear to have "paranoid tendencies." They are trying to steal his assets and eventually his life.
My question is, WHEN are these thiefs going to be completely exposed and held accountable? This corrupt Florida guardianship system has become so bold, that they even steal targets/victims from other states for exploitation and get away with it!! Don't give up Stewart and keep looking over your shoulder.
Of course, it's all about money. That's why NASGA was formed - to create a common voice to fight corruption in guardianship and conservatorship.
Carmel Cafiero is all over this - great job!
Stewart's absolutely right: it's all about money. It's always about money. But the devestation guardianship can cause is about so much more. Innocent and vulnerable people can be ripped from the loving arms of their family and forced into nursing facilities against their will. Guardians can then isolate them from family and friends, causing them to feel deserted and afraid. And where are the courts when this torture is happening? Well, the answer is the courts are in the middle of it all. Litigation is a money maker for lawyers, and the courts promote it rather than discourage it. That's because making money is more important than the lives negetively affected by the litigation.
Florida is one of the states where the elderly and disabled are easy targets. Thank you for posting this important story, NASGA.
If they are successful in getting the temporary guardianship in place (and they usually are) then it will easily morph into permanent guardianship.
We're rooting for you, Stewart. And thank you, Carmel, for exposing this tragedy.
Justice has long left the courtroom and now is pretty much only available through media attention!
My heart aches for Stewart and I will pray he is able to prevail.
this sounds so familiar, Stewart Rosenkrantz is being railroaded and he will find out he will be paying all fees even if the guardianship does not happen yes including his money to those who are trying to get emergency guardianship established which always leads to permanent guardianship til the money is gone or the ward has departed society is in the dark about guardianship and if they have a clue they think they are safe i say wrong no one is safe - no one. Stewart needs more than prayers, he needs to win this thing fast. it is obvious the petition is: fraudulent containing lies i have seen this many times when will these people be criminally prosecuted? thanks to attorney Edward Dinna for taking this case wishing you success good job Carmel for exposing another innocent person marked for destruction under color of law
Sounds like Stewart's the one with capacity and the rest of them have gone nuts!
They're after your money all right, Stewart, and now that they've smelled it, they won't stop. I hope you can fight them off. Publicity is your best weapon!
You would think a judge would just throw this case out, but then again that would be using common sense and it wouldn't make the lawyers any money, so that's likely not going to happen.
Obviously there is a lot wrong with this entire situation.
Does it appear Stewart Rosenkrantz's family is on a mission; they want to claim Stewart's assets for their own now using the guardianship racket as a way in?
Go to square One: THE PETITION FOR EMERGENCY / PERMANENT GUARDIANSHIP of Steward Rosenkrantz
How could the court accept a petition for guardianship if the petition is found to be containling false statements, lies?
Shouldn't this case be: DISMISSED post haste?
Shouldn't this case be: REFERRED TO
LAW ENFORCEMENT?
Shouldn't Stewart Rosenkrantz and his lawyer Edward Dinna have the opportunity to recover any/all expenses and costs related to fighting for Stewart's freedom?
Absolutely it is about money. The system is very corrupt....This needs to change soon before some more unwanted laws are passed such as the health care wgat that will do to our disabled and vulernable society.
