NASGA Celebrates World Elder Abuse Awareness Day June 15, 2009

NASGA is a civil rights organization comprised of victims and families working to expose and end unlawful and abusive guardianships/conservatorships.

It is fitting that on this day of global recognition, NASGA brings to public attention a shocking truth: elderly and/or disabled and vulnerable people are often abused – physically and financially - by their court-appointed “protectors.”

The abuse is enabled under color of law by uncaring or corrupt courts presiding over guardianship / conservatorship cases.

Unlawful and abusive guardianships constitute elder abuse at its worst.
Guardianship wards are often isolated from family and friends and forcibly removed from their homes to nursing homes where they die prematurely, alone and afraid; completely unaware of their families’ constant struggle – almost always in vain - to free them.

The court-appointed fiduciaries and their lawyers engage in dissipating their victims’ assets by exorbitant and/or fraudulent billing, leaving them indigent, to ultimately become a burden on the US taxpayers under Medicaid – quite contrary to the intent of the “protective” statutes.

Many families go to the Office of the Attorney General for help - only to be turned away because the abuse has been court sanctioned.

Americans should be outraged by this public sanctioning of abuse. NASGA calls for legislative reform to stop this insidious crime foisted upon our most vulnerable citizens - the elderly and disabled – by misapplication and misuse of law actually intended to protect them.

Exposing the abuses in the guardianship system of this nation is not an easy task and NASGA is up to the challenge.

Guardianship / conservatorship abuse is indeed elder abuse at its worse.

The system is flawed. It's a much bigger problem than exploitation by family, friends, or caregivers -- the new mantra of the professionals!

Guardianship is an illusion of a warm and fuzzy system, an illusion of a caring judge with court oversight and protection so no harm is done to the ward.

Perception is everything and most folks are in the dark exactly where the guardianship players want you.

Court appointed protectors, the guardians, conservators, in many cases are court appointed predators with a license to steal.

Every day, in every state, in every county, people are on a converyer belt, case after case, turned into products, into Wards who are immediately stripped of all basic and civil rights, thereby becoming helpless, defenseless and vulnerable, turned into prey for the predators with court approval.

Most times, the wards are immediately removed from the comfort and security of their homes and forced to reside in nursing facilities, most often forced to take psychotropic drugs while being isolated from family, clergy and friends.

All of this by design by those who profit, get rich from the guardianship racket directly or indirectly all funded by the wards.

Most folks don't worry about guardianship, elder abuse or financial exploitation until it happens to your beloved family member or if it happens ... to YOU!

On this day of elder abuse awareness, ask yourself, what can you do to make a possitive difference?

I didn't even know there was such a thing as World Elder Abuse Awareness Day!

I am glad to see elder abuse become a world issue.

Thank you for adding the part about how the AG turns us away because they say they can't get involved in litigation.

I believe the AG can get involved and in fact has a duty to get involved.

People need to know that the "guardian" part of guardianship is a misnomer.

They're not guarding anybody.

It's all about getting to the money.

I am glad there's an organization like NASGA who will take on this abuse and work for reform, and I am proud to be a part of it.
