Family Loses Home in Conservatorship

A Douglas County family is trying to figure out what went wrong and why they lost a home to foreclosure. Family members said that a court appointed conservator was supposed to pay the bills on a home belonging to a deceased relative, but the home ended up in foreclosure.

David Brown said he heard about the foreclosure on his late father's house from a voicemail left by neighbor.

"There's a lot of activity over there it looks like their throwing everything on the front lawn," said Brown.

Brown's father, Dr. James Brown died in June. The estate was placed in the hands of a court-appointed conservator until the will could be worked out.

"Larry Smith, the conservator was supposed to preserve the estate. Obviously [he] hasn't done his job," said Brown.

The probate judge in the case, Hal Hamrick referred questions to Smith. Smith said he couldn't comment on the case.

Larry Smith, the conservator to preserve the estate, another conservator who has not done his job then points the finger of blame. I'll bet Larry Smith is in line wanting paid from the estate of Dr. James Brown.

What went wrong is the estate went to a conservator with no oversight!

These conservators/guardians do not care about the ward, nor their possessions, other than getting payment to themselves. The inefficienty is astronomical!

The conservator should be removed from all current and future appointments immediately!

No one should lose their family home to a conservatorship or their loved one to a guardianship. Shame.

It's a shame: They now have to sue the bastard! For breach of fiduciary duty.

And file a grievance against him with the Bar.

Conservator Larry Smith knows nothing about a foreclosure of his ward's home..... but will he still earn his fee??
Larry Smith's lawyer knows nothing about a foreclosure of Larry Smith's ward's home..... but will he still earn his fee??
SunTrust bank knows nothing of the foreclosure, but have they made money on this tragedy?
And the judge in charge of all this.... well, he dont know notin...talk to the conservator, he says!!!
